PERMITTED USE; NO UNLAWFUL OCCUPANCY. Subject to the provisions of applicable law of this Lease, Tenant shall cause the Premises to be used as agreed to by Landlord and Tenant. Tenant shall not use or occupy, nor permit or suffer the Premises or any part thereof to be used or occupied for any unlawful or illegal business.

PERMITTED USE; NO UNLAWFUL OCCUPANCY. Section 23.01. Subject to the provisions of law and this Lease, Tenant shall occupy the Premises in accordance with the Certificate or Certificates of Occupancy for the Premises, the Occupancy Agreement, the Master Development Plan and the Design Guidelines, and for no other use or purposes. Notwithstanding the provisions of the immediately preceding sentence, in the event Tenant shall have elected to terminate the Funding Agreement pursuant to the provisions of Section 9.6(b)(ii)(B) thereof, then, for a period of five (5) years commencing on the Occupancy Date, (i) Tenant shall use and occupy the Premises for its world headquarters, and (ii) Tenant shall retain its headquarters, executive, administrative and clearinghouse facilities and offices which relate to floor trading of futures or options (not including its Host Computer (as such term is defined in the Occupancy Agreement)) at the Premises, and all other provisions of the Occupancy Agreement shall be of no further force or effect.
PERMITTED USE; NO UNLAWFUL OCCUPANCY. Subject to the provisions of law and this Lease, the Sublease and the Sub-Sublease, Tenant shall cause the Premises under the Sub-Sublease to be used as a facility for Class III Gaming (as such term is defined in 25 U.S.C. §2703(8)) for gaming and commercial activities traditionally associated with the operation or conduct of a casino facility. Tenant shall not use or occupy, nor permit or suffer the Premises or any part thereof to be used or occupied for any unlawful or illegal business, any use or purpose inconsistent with the above permitted uses.
PERMITTED USE; NO UNLAWFUL OCCUPANCY. The parties agree that the use of the Premises shall be for industrial/manufacturing or for any other legal use as permitted by the Certificate of Occupancy for the Premises, and for no other purpose, subject to the provisions of this Lease. Tenant shall not use or occupy, nor permit or suffer, the Premises or any part thereof to be used or occupied for any unlawful purpose, nor in such manner as to constitute a nuisance of any kind, nor for any purpose or in any way in violation of the then existing certificate of occupancy, if any, or of any present or future Legal Requirements or Insurance Requirements. Tenant shall promptly upon the discovery of any such unlawful or illegal use take all necessary steps, legal and equitable, to compel the discontinuance of such use.

  • Ready for Occupancy For purposes of Section 1.3.2 of this Agreement, the Premises shall be deemed “Ready for Occupancy” upon the substantial completion of the Tenant Improvement Work. Subject to Section 4.2 below, the Tenant Improvement Work shall be deemed to be “substantially complete” upon the completion of the Tenant Improvement Work pursuant to the Approved Construction Drawings (as reasonably determined by Landlord), with the exception of any details of construction, mechanical adjustment or any other similar matter the non-completion of which does not materially interfere with Tenant’s use of the Premises.

Lessor shall fully cooperate with Lessee in the prosecution of any such claim, in Lessor’s or Lessee’s name, all at Lessee’s sole cost and expense.   • Landlord’s Access Landlord shall be entitled at all reasonable times and upon reasonable notice to enter the Premises to examine them and to make such repairs, alterations, or improvements thereto as Landlord is required by this Lease to make or which Landlord considers necessary or desirable; provided, Landlord shall comply with all law in respect of any such entry; Landlord may require Tenant provide an accompanying staff member or employee with any such entry; Landlord will honor any specifically closed-off areas as may be required by law for security and safety; but Landlord may nonetheless act as prudent and necessary in case of emergency. Tenant shall not unduly obstruct any pipes, conduits, or mechanical or other electrical equipment so as to prevent reasonable access thereto. Landlord shall exercise its rights under this section, to the extent possible in the circumstances, in such manner so as to reduce, if practical, interference with Tenant’s use and enjoyment of the Premises. Subject to the foregoing, Landlord and its agents have the right to enter the Premises at all reasonable times and upon reasonable notice to show them to prospective purchasers, lenders, or anyone having a prospective interest in the Buildings, and, during the last six (6) months of the Term or any renewal thereof, to show them to prospective tenants. Landlord will have the right at all times to enter the Premises with Tenant or licensed individual(s) on behalf of the Tenant to escort the Landlord in the event of an emergency affecting the Premises, subject to any applicable limitations required by the Marijuana Code or any other applicable regulations. Although Landlord shall not have the right to place “For Lease” signs in the Premises, or upon the exterior of the Premises itself, nothing herein shall limit Landlord’s rights to promote, advertise, place “For Lease” signs or otherwise market leasing of the Property in whatever lawful manner Landlord may elect, as long as such manner(s) do not materially interfere with the Premises.
