Pipeline. 1. A Pipeline which commences within the Special Regime Area and lands in the territory of Australia shall be under the exclusive jurisdiction of Australia. A Pipeline which commences within the Special Regime Area and lands in the territory of Timor-Leste shall be under the exclusive jurisdiction of Timor-Leste. The Party exercising exclusive jurisdiction has both rights and responsibilities in relation to the Pipeline.
2. The Party exercising exclusive jurisdiction under paragraph 1 of this Article shall cooperate with the Designated Authority in relation to the Pipeline to ensure the effective management and regulation of the Special Regime Area.
3. There shall be open access to the Pipeline. The open access arrangements shall be in accordance with good international regulatory practice. If Australia has exclusive jurisdiction over the pipeline, it shall consult with Timor-Leste over access to the Pipeline. If Timor-Leste has exclusive jurisdiction over the Pipeline, it shall consult with Australia over access to the Pipeline.
Pipeline. NREG shall progress the pipeline work as agreed during the bargaining for renewal of the 2012-13 MECA (refer to the terms of settlement). This includes considering any issues that may arise from the Medical Council of New Zealand’s changes to the education and training framework for first and second year house officers.
Pipeline. For Materials received into the Tankage by a pipeline, custody of the Materials shall pass to Logistics at the point in the applicable tank’s receiving line where such Materials enter the perimeter of the land leased or owned by Logistics surrounding that tank. For Materials delivered by the Tankage into a pipeline, custody of the Materials shall pass to Refining at the point in the applicable tank’s delivery line where such Materials leave the perimeter of the land leased or owned by Logistics surrounding that tank. For Materials received into the Terminal by a pipeline, custody of the Materials shall pass to Logistics at the point in such pipeline where such Materials enter the perimeter of land leased or owned by Logistics surrounding the Terminal.
Pipeline. 4.1 Notwithstanding any rule of law or equity to the contrary, the Pipeline shall at all times remain a chattel and the personal property of EPCOR or its assigns and shall not become part of the Lands, notwithstanding that it may be annexed or affixed to the Lands or abandoned by EPCOR.
4.2 EPCOR shall install, construct, operate and maintain the Pipeline in a responsible manner so as to minimize damage to the Lands and shall, where practicable, after any such work restore the Lands to substantially its original level and condition, save and except for any soil rise above grade to allow for soil settlement (the “Restoration Work”). EPCOR shall not be responsible for any damages caused by subsidence after levelling is completed, provided the subsidence does not occur as a result of negligence on the part of EPCOR. Notwithstanding the foregoing, or Clause 7.1, EPCOR shall only be obligated to compensate the Owner for damage to buildings or improvements that may be placed within the Lands, and arising from the exercise by EPCOR of its rights under this Agreement, if EPCOR has given its prior written consent pursuant to Clause 5.2 to the placement of such buildings or improvements within the Lands.
4.3 If EPCOR has not commenced the Restoration Work within a period of ninety (90) days following completion of the Pipeline, the Owner may after thirty (30) days prior written notice, complete the Restoration Work, in accordance with all applicable requirements including TSSA requirements and if such requirements must be completed by a natural gas utility the Owner shall not complete any portion of the Restoration Work governed by those requirements, provided there is no interference with the Easement Rights. EPCOR shall pay to the Owner within fifteen (15) business days following demand, all reasonable amounts paid by the Owner in respect of such Restoration Work.
4.4 EPCOR shall have the right to temporarily fence and use such portions of the Lands as may in its opinion be required. If at any time EPCOR shall require temporary fencing for maintenance or operational reasons, such fencing shall be temporary and EPCOR shall obtain the prior written consent of the Owner, acting reasonably, as to the type, term and location of any fencing and shall locate such temporary fencing insofar as may be practicable so to do, in such a fashion as to provide a minimum of inconvenience to the Owner. Pipeline. There is about 1,950 miles of various sizes of pipe ranging from 2" to 14", 0.156 Gr B to 0.365 x 46 w.t., and 1957 - 1992 vintage. The lateral lines are up to 8" and the trunk portion is all 10" and 14".
Pipeline. For Pipeline movements, the volume will be determined by the Marine Vessel receipt and/or load volumes in Section 11(a)(i) above for the portion of the Marine Vessel receipt and/or load volume delivered to or received from the Wilmington Refinery by the Pipelines. For Marine Vessel discharge or load volume which is delivered to or received from third party pipelines or terminals and the Wilmington Refinery, the Pipeline movement volume will be determined by the difference between the total volume discharged from or loaded to the Marine Vessel less the volume delivered to or received from a third-party pipeline or terminal. Customer shall provide Operator with all reasonable documentation with respect to the volumes throughput across the Berths, including but not limited to, inspection reports, meter tickets or other similar documentation within three (3) Business Days of completion of Marine Vessel discharge.
Pipeline. For pipeline movements by (i) pipeline meter ticket, when available; otherwise (ii) by taking static tank gauges of the tanks.
Pipeline. If the Schedule allows Customer to deliver, or cause to be delivered, Product to or receive Product, or cause Product to be received, from the Terminal by Pipeline, the procedures in this Section 9.01(b) will apply. Company will receive and redeliver Product by Pipeline 24 hours per day, 7 days per week in accordance with the agreed-upon scheduling.
Pipeline. The pipeline system consists of 23.4 miles of 16” pipeline, 2 main line pumps, 2 booster pumps, 10 intermediate block valves, along with other valves, piping, pumps, tanks, sumps, controls, instrumentation and other associated equipment to receive products from the Refinery and transport to Sunoco Logistics Pipeline connection at Twin Oaks.
Pipeline. If the Joint Companies are requested under sub-clause (1) of clause 3 or give notice pursuant to sub-clause (2) of clause 3 of their desire to construct the oil refinery, then the Joint Companies shall be entitled to a licence for transport of petroleum between the lease area and the oil refinery.
