POSTING AND FILLING VACANT POSITIONS. 1. The Board and Local agree that it is desirable to minimize the occurrences of students in the same class being taught by a succession of teachers in the same school year. The circumstances which give rise to such occurrences can arise for reasons beyond the control of either the Board or the Local. The Board and the Local will make every reasonable effort to minimize these occurrences. a. Where a problem arises in the application of a posting and filling provision the Board and the Local may agree to a solution which is inconsistent with the provision. In such cases, the solution is without prejudice and does not constitute a waiver of rights by the Board and the Local. b. For greater clarity, the obligation set out in this section is an obligation to make every reasonable effort. Despite paragraphs (1) and (2), this section does not take away from nor add to the rights of any employee, nor does it require a local union or a school district to amend or waive a provision of the agreement. 2.
