Posting of Jobs. A. B. Regular Employees promoted to a new job classification shall be given a trial period in that new position board for a period of three (3) monthsregular working days. IfAny employee wishing to apply shall do so on forms to be supplied by the Company within three (3) regular working days and within a further five (5) regular working days the Company will post the name of the successful applicant. An employee, during who will be off work on an approved leave of absence, vacation, or maternity leave, must inform the trial Union of their intention to be considered for any job posting for which they would be able to apply, prior to their leave or vacation commencing. An employee off work on sickness and accident or Workers’ Compensation must notify the Union of their intention to be considered for any job postings, within (7) seven days of their absence from work. The most senior applicant who has the skill and ability to satisfactorily perform the job will be awarded the job. Exception will be made when awarding a full time Die Setter position; the most senior Set-up Operator applicant will first be awarded the position. If a Set-up Operator does not apply for the position, it will then be awarded to the most senior employee who has the skill and ability to satisfactorily perform the job.
(a) The Company and the Union Committee will meet before the posting of a job to discuss any job requirements. Failure to comply will result in voided posting. The Company reserves the right to stipulate, in the posting of a job any reasonable requirements which will be needed by the applicants. Where there are no qualified applicants, the Company may fill the job or vacancy in any manner it sees fit.
(b) All successful full-time job applicants shall be accepted as being reclassified at the new classification after fifteen (15) days worked of their acceptance of the posted position except in the case of the set up operator and set-up position. The successful full-time applicant will be given a reasonable familiarization and training period of at least fifteen (15) days worked. The training period for a set up operator or set-up position will be determined mutually by the Company and Union and may be extended up to a maximum of (45) forty-five days worked. If an employee is awarded a job posting they previously have performed, the fifteen (15) day training period will not be required, however in some circumstances a five (5) day familiarization period may be granted at the discretion of the Company. This same fifteen (15) days worked, except in the case of the set up operator or set-up position, shall act as the new job probation period for the employee. Whereupon reasonable grounds it is decided that the employee is not fully capable of performing the duties of the new job or the employee removes himself from the awarded position prior to completing the training period, the regular Employee is demoted employee will be allowed to return to their former job. Should the employee resign from the new positionposition after the training period is complete, or if the Employee should desire to vacate the position, the following procedure shall take place:
1. If a vacancy in the regular Employee's former position exists, the Employee shall they will be returned to the Production Operator classification as soon as a replacement is adequately trained and fully capable of performing the duties of the position. The employee shall be entitled to the wage rate for the new job or full-time vacancy upon completion of the fifteen (15) day period except in the case of a set up operator or set-up position, who will be entitled to the wage rate upon completion of the training period.
(c) Any successful full-time applicant who completes the fifteen (15) day or greater work period shall be precluded from further bidding on another new job or vacancy for a period of two (2) months unless the new job or vacancy is the result of a new classification and/or an increase of pay from their previous posting.
(d) In the case of postings for back-up positions, there will be a fifteen (15) day training period. However, the employee must accept or decline the position after the first ten (10) days of training. Whereupon reasonable grounds it is decided that the employee is not capable of performing the duties of the back-up position, or the employee removes him or herself from the awarded back-up position prior to completing the first ten (10) days of training, the employee will be allowed to return to their former job. Should the employee resign after that point, he or she shall be precluded from further bidding on another back-up posting for a period of six (6) months. Once an employee has successfully completed the training period he or she shall be precluded from further bidding on another back-up posting for a period of six (6) months.
15.02 If the Company adds a new job or classification, the rate of pay and classification will be negotiated by the Union and the Company and if an agreement is not reached between the parties it will be the subject matter for grievance and arbitration procedure.
15.03 The Union agrees and recognizes that the measurement of work and determination of time standards is solely and exclusively a management function. If a dispute arises regarding the production rates set for a job, the Union may request for a National Time Study Representative to be allowed to examine the process, as part of the grievance procedure. The speed of operations and production standards shall be based upon accepted work measurement techniques made on the basis of fairness and equity, consistent with quality workmanship, efficiency of operations, the reasonable work capacity of normal operators and shall give due consideration to fatigue, personal time and on-cyclic work elements.
15.04 If a member of the committee posts for a new classification and is awarded the position based on their seniority and qualifications, but cannot receive the training required for the job because of negotiated time off the job to do Union business, he/she will be paid at the negotiated rate of pay after fifteen days worked and will receive his/her training after such time the employee is relieved from their Union duties. Until such time, this position will be filled in the plant as a full-time position.
2. If no vacancy exists15.05 When an employee is awarded a posting and requires training, the Employee may apply for any other District job opening for which the Employee is qualified.

Posting of Jobs. A. 14.01 Job posting, shall be carried out in accordance with the following principles.
14.02 The District agrees purpose of job posting is to post all job openingsestablish an orderly and fair procedure for upgrading employees based upon qualifications to the Company's requirements and seniority. Where there exists, which it intends to fill, on bulletin boards in respective work areas in order that Employees the view of the District shall have Company, and the opportunity Union, valid and sufficient reasons, employees may be permitted to apply for any and all jobs for which they are qualified. For all qualified candidates, seniority will prevail for all promotions when candidate qualifications are equalbid on vacancies in lower rated classifications.
114.03 It is understood that except in effecting promotions to supervisory positions, notice of new jobs or vacancies available will be posted for three (3) working days and appointments to such vacancies will not be made before the expiry of the three day period. Notice of each job vacancy which Employees wishing to bid on these jobs may do so in writing on forms supplied by the District intends to fill or new job opportunity Company, within the bargaining unit shall be posted on Employee bulletin boards for a period of five three (53) working days. The notice Company agrees to furnish the Union with a copy of the posting and a copy of the applicant's application form. The Company further agrees to post the successful applicants on the bulletin board and provide a copy to the Union.
14.04 An applicant who has been appointed to fill a vacancy that has been posted shall set forth incur no loss in seniority. The successful applicant may not make application for any other vacancy during the nine month period following the date of his/her appointment unless approved by the Company.
14.05 An employee who successfully bids on a posted job will lose his/her former classification and location.
2. All regular Employees take his/her seniority to his/her new job, and the Company shall be eligible to bid on all such job vacancies or new job opportunities.
3. Only bids received during retain the posting period set forth above will be considered by the District.
B. Regular Employees promoted to a new job classification shall be given a trial period in that new position right for a period of three thirty (30) working days to transfer the employee to his original classification if in the Company's opinion such employee has not demonstrated the necessary skill and ability to perform the work required. After thirty (30) working days, the transfer will be permanent.
(1) The Company shall not be required to post for a vacancy created by a temporary leave of absence authorized by the Company. Where an employee is transferred to said vacancy, he/she shall receive the rate pertaining to the classification or his/her regular rate, whichever is the higher.
(2) The Company shall be required to post for one working day for a temporary vacancy (not exceeding ninety days). Where an employee is transferred to said vacancy, he/she shall receive the rate pertaining to the classification.
(3) monthsIn the event that the temporary vacancy is filled by an employee presently at work, the subsequent vacancy created by filling such temporary vacancy need not be posted. IfIf the temporary vacancy is filled by someone other than a bargaining unit member, upon the expiration of ninety (90) days such temporary vacancy shall be posted in accordance with Article 14.03.
(4) If a temporary vacancy is subsequently posted pursuant to Article 14.03, experience gained during the trial period, the regular Employee is demoted from the new position, or if the Employee should desire to vacate the position, the following procedure shall take place:
1. If temporary vacancy by a vacancy person not in the regular Employee's former position exists, the Employee shall be returned to the former position.
2. If no vacancy exists, the Employee may apply for any other District job opening for which the Employee is qualified.
3. If no other vacancy exists, or if the Employee is unsuccessful in applying for another job, such Employee shall be temporarily placed in the Laborer classification at the percentage salary rate based on the employee's length of employment with the District. Regardless of the actual work performed by the Employee, any such Employee so placed bargaining unit shall not be entitled considered in determining a person's "qualifications" under Article 11.06.
14.07 If in the judgement of the Company:
(1) none of the applicants has the required skill and ability to extra compensation provided herein, under perform the job
(but not limited to2) provisions relating none of the applicants could be trained to "out fill the requirements of class pay", "xxxxxxx I" and “xxxxxxx II”. At such time as a vacancy exists the job in a position for which such Employee is qualified and/or satisfactorily held previously, such Employee shall be assigned to that position without having to bid for itreasonable period of time.
4. Provision "B" (3) no one applies, then the Company may hire from outside.
14.08 Job description covered by this agreement will be made available to the Supervisor and Chairperson of this section shall not apply to any Employee terminated by the DistrictUnion Committee.
