Common use of Preference in Hours of Work Clause in Contracts

Preference in Hours of Work. 1. The Employer recognizes the length of continuous service of an Associate in scheduling hours of work. Management reserves the right to determine the total hours available and the length and times of shifts. Preference in hours of work will be given to senior Associates provided they are available and have the ability to perform the work. Available hours of work shall be maximized in accordance with seniority, ability and availability on a daily basis. In the event of a reduction in the number of hours available within an employment category, the junior Associates will have their hours of work reduced first. In the event of a dispute under this provision, the Parties agree to refer all such disputes, which cannot be resolved internally, to Xxxxx Xxxxxx, whose decision shall be final and binding.
