Common use of PRESENT CONDITIONS Clause in Contracts

PRESENT CONDITIONS. No present employee who prior to the date of this Agreement was receiving more than the rate of wages designated by this Agreement for the class of work in which he or she was engaged shall suffer a reduction in the rate of wages or other benefits from the application of this Agreement. Provided, however, where premium amounts are based upon special work assignments or performance, these premiums above the contractual amounts may be reduced should the employee’s special assignment/performance be the reason for the reduction.
