Processing Restrictions. 3.1 If at any time the volume of CNP Transactions, substantially exceeds the projected annual volume stated on the Application, or if at any time Processor or Merchant Bank suspects fraud, money laundering or violations of the Operating Rules, Processor or Merchant Bank may, in their sole and absolute discretion and in addition to other remedies that Processor or Merchant Bank may have:

If at any time the volume of CNP Transactions, substantially exceeds the projected annual volume stated on the Application, or if at any time Bank suspects fraud, money laundering or violations of the Operating Rules, Bank may, in its sole and absolute discretion and in addition to other remedies that the Bank may have: (1) refuse to process the excessive or suspect CNP Transactions; (2) process the CNP Transactions and retain the funds received from processing until such time as the excess or suspect Charges are found to be valid or invalid and processed in accordance with the Operating Rules; (3) suspend the CNP Transactions and/or terminate the Agreement; or (4) amend the Agreement to protect the interests of Bank.
Processing Restrictions. Notwithstanding any other term of the Agreement, Google will not process Customer Data for Advertising purposes or serve Advertising in the Services.
Processing Restrictions. 8.1 MERCHANT understands that FNBO is not responsible for and is not able to provide customer service for the POS devices installed by and/or operated by any Third Party with which MERCHANT has contracted. MERCHANT should contact the Third Party for service in respect of this equipment. MERCHANT shall not allow any Third Party to install, remove, or modify any terminal software application at MERCHANT's location without the express written consent of FNBO. MERCHANT understands and agrees that FNBO can only process SALES that are received by FNBO, and that any Third Party is responsible for ensuring that the SALES are formatted and transmitted to FNBO in accordance with the then current FNBO and ASSOCIATIONS' requirements. MERCHANT also understands and agrees that in the event that a Third Party presents SALES transactions that are not in accordance with the then current ASSOCIATIONS' requirements that the FEES charged to MERCHANT by FNBO may increase.
Processing Restrictions. Subject to Section 2.1, the Data Processor shall only process Personal Data in accordance with instructions from the Data Controller. The Data Processor shall not process Personal Data beyond the requirements necessary to comply with the obligations under the Agreement without prior written agreement or written instructions from the Data Controller.

Google will ensure that Subprocessors only access and use Customer Data in accordance with the terms of the Agreement and that they are bound by written obligations: (i) that require them to provide at least the level of data protection required by the Safe Harbor Privacy Principles; and (ii) if Customer (or an authorized Customer Affiliate established in the European Economic Area) has entered into Model Contract Clauses with Google Inc., that impose the level of data protection required by the Model Contract Clauses.

The nature and purpose of the processing of Customer Personal Data, the duration of the processing of Customer Personal Data, and the types of Customer Personal Data subject to processing, are set forth in the Agreement, this Addendum, and the Schedules hereto.

MERCHANT agrees SPC can only process VOYAGER SALES received by SPC, and any third party is responsible for ensuring VOYAGER SALES are formatted and transmitted to SPC in accordance with the then current requirements of SPC AND VFSI. SPC may increase VOYAGER FEES if a third party presents VOYAGER SALES transactions not in accordance with the then current requirements. MERCHANT assumes full responsibility and liability for third party providers’ failure to comply with the VOYAGER RULES. MERCHANT is responsible for obtaining from the third party provider any information needed by SPC.
