Production Guarantee. The regular member of the AQPM is subject to Article 19.04 unless the Producer elects to provide the Guild with security in the form of a production guarantee from the parent corporation member of the AQPM and who owns 100% of the shares of the Producer to cover the total of the Director’s remuneration and all Guild remittances. The production guarantee shall be in the form set out in Appendix 6.
Production Guarantee. If the annual Energy delivered to the Delivery Point from the System in any calendar year is less than or equal to 316,685 kWh in the first year, degrading at 0.5% per year thereafter (the “Guaranteed Production”, which shall be permanently adjusted to reflect any changes to the “as built” size of the System, but shall not be less than 90% of the projected first year production for that System size, and may be adjusted for each calendar year following the end of such year in a manner consistent with standard industry practice using actual weather data for such year that is collected at the Site or obtained from publicly available data at government or educational weather stations located in Connecticut within 50 miles of the Site), Provider must pay Host for the actual positive difference of the cost of procuring the shortfall in production below the Guaranteed Production for such year. Provider will deliver an annual production report before April 1 of each year, that compares actual production to the Guaranteed Production (as adjusted), as well as the basis for any calculations or adjustments and the source of any data used to perform any weather-related adjustment. In the event of any shortfall reflected on the annual production report, Host will send Provider an invoice for any amount due, which shall include reasonable documentation (including utility or retail electric supplier bills) related to the amount of any excess energy purchased for the Site and the price paid therefore. If Provider fails to make the payment required under this section, it shall be an event of Provider default.
Production Guarantee. 12.1.1.1 The Company will provide 97 production units per Boner or Slicer per 8 hour shift worked, based on the attached Production Table in Appendix 2 of Part A of this Agreement. This guarantee eliminates all waiting time penalties for all shifts and also eliminates shift allowances.
12.1.1.2 The ratio of Slicers to Boners is generally 1:1. Variations in the numbers will occur based on the type of cattle being sliced. For example, two [2] additional Slicers are required when slicing Jap cattle for Full Set production. Other variation in the number of Slicers will result from EU, Taiwanese shin, rostbiff, ats & eyes, heavily denuded cuts, excessive fat, seven [7] rib steer, etc.
12.1.1.3 Should a mechanical breakdown occur which limits the units processed during overtime to less than 12.125 units per hour [pro rata for part there of] then 14.5 units will be paid per overtime hour. [Pro rata for part there of].
Production Guarantee. Each District Council will continue to accept security in the form of a production guarantee (Schedule 10) from each Producer who was granted that right previously on the last Production undertaken by the Producer prior to the effective date of the Standard Agreement. Production Guarantee. Providing a performance/production guarantee: Installer guarantees that the PV System will generate ninety percent (90%) of the weather-adjusted expected output during the Term of this Agreement (the Lease), as well as provide a minimum of 50% reduction in the District’s average residential electric bills for 2016 (which equates to 4,200kWh per year). In the event either of the conditions above is not being met at any time, Installer will perform annual or remedial maintenance (as applicable) on the PV System in accordance with applicable law and the warranties provided by the manufacturers of the components of the PV System, which shall include, but not necessarily be limited to:
a. Performing a visual inspection of the solar PV modules, mounting system, inverters, wiring, conduits, and data acquisition system to ensure none of the components of the System has been damaged at least annually;
b. Repairing or replacing any damaged or non-functioning solar PV modules;
c. Cleaning all of the solar PV modules;
d. Repairing or replacing any damaged mounting hardware, inverters, wiring, conduits or components of the data acquisition system;
e. Ensuring all electrical connections are tight and the racking system is firmly attached to the roof; and
f. Making sure any roof penetrations are properly sealed with waterproof sealant.
Production Guarantee. The Company will provide 35 tally units per Slaughterperson per day worked based on one Tally Unit per head of cattle. (e.g. 18 Slaughterperson team by 35 Tally Units per Slaughterperson equates to a kill of 630 head per day). This guarantee eliminates all waiting time and penalties excluding penalties for bulls. (See Appendix 2 for details.)
Production Guarantee. At the District Council entire discretion and notwithstanding article 12.8 (a), the Producer shall not be required to post as security a cash bond, or letter of credit, but shall instead be entitled to provide the District Council with a Production Guarantee from the company holding the copyrights to the film, as per Annex 5, Production Guarantee. The Producer shall give the District Council notice no later than 30 days prior to the start of principal photography of its intention to provide a Production Guarantee.
Production Guarantee. Designer/Builder hereby guarantees to Customer guaranteed energy output from each System as indicated in the attached Exhibit “H” (Solar Systems Production Guarantee) (“Production Guarantee” or “Performance Guarantee”).
