Proof of Performance. Seller shall perform an end-to-end swept frequency response test of all the trunk facilities of the CATV Systems to 330 MHz, and demonstrate a "peak-to-valley" ratio of less than 3dB between adjacent channels and less than 10dB between all other channels.
Proof of Performance. Except as may otherwise be agreed in writing by the Guild and the AMPTP, the Guild, prior to the commencement of principal photography of a motion picture on which one or more Employees covered by this Agreement are employed, may require that the Company provide the Guild with a security interest in the motion picture and those rights necessary for the distribution of said picture for the purpose of securing Residuals, as that term is used in Article 30 of this Agreement, which are or may become due with respect to said motion picture. Before foreclosing on any security interest, the Guild shall notify the Company and Distributor of the default and advise the Company of its right to cure same within thirty (30) days.
Proof of Performance. 31.1 The Contractor guarantees the performance of the proposed solution as per Annex-B for a period of thirty six (36) months after issuance of provisional acceptance certificate. Failure to meet technical requirements as specified in Annexure B, which do not conform to the Specifications shall be sufficient cause for USF to require further testing at the cost of Contractor.

Proof of Performance. (Commercial Stations Only) Affiliate shall complete and return a Declaration of Clearance ("Declaration") with the executed Agreement. This Declaration is binding until Network is notified and agrees to any changes. If Affiliate at any time reformats the Station, whereby it is incapable of complying with its original Declaration, a new Declaration shall be completed promptly by Affiliate and returned to USA for approval. The original and any subsequent Declaration sent to USA must show clearances that meet or exceed the minimum broadcast requirements of USA.
Proof of Performance. At the onset of the Services, TEGRIT and FCERA will engage in a Proof of Performance period as detailed in an initial SOW attached to this Agreement. The purpose of the Proof of Performance period is to prove the working relationship and TEGRIT’s ability to deliver to FCERA’s expectations as established in this Agreement, prior to either party making a substantial financial investment. If FCERA determines the working relationship to be flawed without remedy, FCERA reserves the right to terminate this entire Agreement with no further obligations to TEGRIT subject to the termination terms established in this Agreement with payment as agreed in the SOW for the Proof of Performance and elsewhere.

Buyer shall perform an end-to-end swept frequency response test of all the trunk facilities of the Huffxxx Xxxtem to 330 MHz, the Prarie View System to 300 MHz, the Cut and Shoot System to 300 MHz, the Brooxxxxxx Xxxtem to 270 MHz, the Tarkxxxxx Xxxtem to 270 MHz, the Ace System to 270 MHz, and the Simoxxxx Xxxtem to 300 MHz, and demonstrate a "peak-to-valley" ratio of less than 3dB between adjacent channels and less than 10dB between all other channels.
Proof of Performance. Challenges to the accuracy or completeness of reports must be submitted to Media Company in writing within 10 business days of submission of report to Advertiser or Agency, as applicable. Pursuant to the foregoing sentence, upon Advertiser’s or Agency’s provision of notice to Media Company that Media Company delivered an incomplete or inaccurate report or no report at all, Media Company will cure such failure by delivering an accurate or complete report within five (5) business days of receipt of such notice. In the event that Media Company fails to deliver an accurate and complete report within the time specified, Agency may initiate makegood discussions pursuant to Section VII below. In addition, failure to cure may result in delayed or nonpayment for all activity for which data are incomplete or missing until Media Company delivers the accurate and complete reports.
