Qualification of the Bidders. 3.1 The Bidder, to qualify for the award of contract, shall upload a written power of attorney authorizing the signatories of the bid to participate in the bid. 3.2 The bidder shall upload full details of his Agency / Firm or, if the bidder is a Proprietorship/Partnership or a Private Limited Company, full details of ownership and name of the directors. 3.3 Bidder shall upload a copy of (Permanent Account No. Card) under the Income Tax Act. 3.4 Bidder must upload copies of all documents asked for in this tender, duly self-attested, along with technical bid of the tender. 3.5 Bidder is required to confirm and declare with his bid that no agent, middleman or any intermediary has been, or will be engaged to provide any services, or any other item or work related to the award and performance of this contract. They will have to further confirm and declare that no agency commission or any payment which may be construed as an agency.

Qualification of the Bidders. 34.1 Before awarding a Framework Agreements, the Procuring Agency shall determine, to its satisfaction, whether the eligible Bidder(s)with substantially responsive Bid(s)that are able to meet the award criteria, meet(s) the qualifying criteria specified in Section III, Evaluation and Qualification Criteria.
Qualification of the Bidders. 4.1 All Bidders shall include the following information and the documents required in Section 6, Volume 3 – additional information, unless otherwise stated in the Contract Data, Volume 3. (a) copies of original documents defining the constitution or legal status, place of registration, and principal place of business; written power of attorney of the signatory of the Bid to commit the Bidder; (b) authority to seek references from the bidder’s bankers; (c) information regarding any litigation, current or during the last five years, in which the Bidder was/is involved, the parties concerned, and the disputed amounts; and awards; (d) proposals for subcontracting components of the Works amounting to more than 10 percent of the Contract Price. The ceiling for sub contractor's participation is stated in the Contract Data, Volume 3. 4.2 Bids submitted by a joint venture of two or more firms as partners shall comply with the following requirements, unless otherwise Section 1 Engineering Division, Ministry of Housing and Environment stated in the Bidding Data: (i) the bid shall include all the information requested in clause 4.1 above for each joint venture partner. (ii) the bid shall be signed so as to be legally binding on all partners: (iii) all partners shall be jointly and severally liable for the execution of the Contract in accordance with the Contract terms; (iv) one of the partners will be nominated as being in charge, authorized to incur liabilities, and receive instructions for and on behalf of any and all partners of the joint venture; (v) the execution of the entire Contract, including payment, shall be done exclusively with the partner in charge; and (vi) a copy of joint venture agreement entered into by partners shall be submitted with the bid. 4.3 a consistent history of litigation or arbitration awards against the Applicant or any partner of a Joint Venture may result in disqualification of the bid.
Qualification of the Bidders. If a Bidder does not provide clarifications of its Bid by the date and time set in the Purchaser’s request for clarification, its Bid may be rejected.

  • ELIGIBILITY OF E-BIDDERS 1.1. Parties who are interested to participate in public auction (“E-Bidders”) may do so by logging on to EHSAN AUCTIONEERS SDN. BHD. Website and register as a member. 1.2. E-bidders who register as a member to participate in the public auction via EHSAN AUCTIONEERS SDN. BHD. website shall: a. Be of 18 years and above, sound mind and not an undischarged bankrupt; b. For a company, be incorporated under the laws of Malaysia and must not be in liquidation; c. Be able to take, fulfil and perform all necessary actions, conditions and matters (including obtaining any necessary consents) in terms of law to enable E-bidders to participate in the public auction and complete the purchase in the event of successful bid. 1.3. E-bidders’ eligibility requirements are also subject to the existing Federal and State legal provisions. Non-Malaysian E-bidders or companies are also advised to take note of restrictions applicable on foreign purchase imposed by relevant authorities.

  • Verification of the Registration of E - Bidders 6.1. Registration shall subject to verification and approval of the Auctioneer’s website and subject further to bank’s clearance of deposit payment. Please take note that approval from the Auctioneer’s administrator may take at least 1 working day and any improper, incomplete registration or late registration may be rejected at the sole discretion of the Auctioneer. Neither the Auctioneer nor its website nor its agents and/or representative bears any responsibility or assumes any liability in the event that the registration of a prospective E-Bidders is rejected and/or delayed for any reason whatsoever. In the event of the registration is rejected, the deposit paid (if cleared by the bank) shall be refunded to the same bank account from which the deposit transfer was made within three (3) working days. 6.2. Upon approval and verification by the Auctioneer’s website and subject to the deposit payment being cleared by the bank, registered E- Bidders will receive a password, i. e. “PIN”, and a secured hyperlink via WhatsApp to the registered mobile number or email which allows the registered E-Bidders to bid for their intended property on the auction day. 6.3. Registered E-Bidders hold the utmost responsibility in the privacy and confidentiality of the given user ID and password. In the event of given user ID and password disclosed to any other person at any time intentionally or unintentionally, the registered E-bidders must notify immediately to the Auctioneer.

  • Qualifications All authorizations, approvals or permits, if any, of any governmental authority or regulatory body of the United States or of any state that are required in connection with the lawful issuance and sale of the Shares pursuant to this Agreement shall be obtained and effective as of the Closing.
