Qualification Testing. Qualification testing of selected initial production units of each Product manufactured by Seller for AT&T shall be conducted and completed before the first scheduled shipment of that Product to AT&T. Such testing shall occur, at the option of AT&T, either at Seller's facility or on the premises of AT&T and shall be at the expense of the party on whose premises the testing is conducted. Qualification testing shall determine the acceptability of the Product in accordance with the Specifications, and shall be conducted in accordance with the PQA Procedure. Upon written agreement of Seller and AT&T that the qualification tests have been successfully completed, the initial deliveries of production units of that Product shall commence in accordance with the scheduled shipment established by issued Purchase Orders.
Qualification Testing. An employee shall be paid for time spent qualifying which includes the driving skills test administered through the county, and a physical examination.
Qualification Testing. An employee shall be paid for time spent qualifying which includes the Commercial Drivers License (CDL) administered through the Secretary of State's Office, the driving skills test administered through the county, and a physical examination. The employee will be entitled to compensation for a successful attempt on a written CDL test not to exceed two hours of compensation.
Qualification Testing. Upon the request of GPI, CI at CI's discretion and expense, shall test GPI's Licensed Products under development and provide GPI with reports, evaluations and recommendations to improve the performance of the Licensed Products and to determine to the best of CI's ability that the Licensed Products performance is compatible with, and generally the same as, that of the OEM.
Qualification Testing. Employees in classifications other than secretarial shall be required pass a test in order to qualify for a secretarial opening.
Qualification Testing. In addition to the review and approval procedure of paragraph 4.2 above, Credence may further require that any proposed changes made by Licensee to the designs or manufacture of the JVC Products to be qualified by Credence before being included in the designs or manufacture of the JVC Products by Licensee. In such event, the qualification criteria and procedures may be the same or comparable to those used by Credence to qualify its own products for shipment.
Qualification Testing. Before a nation accepts any product on which qualification testing is required it is necessary for that nation to ensure that the qualification tests are performed, officially or under official supervision. In the case of imported products, each nation is to ensure that the product has received qualification (see paragraph 4). The general characteristics obtained during qualification shall be available, on request, for subsequent identification of the product so that results obtained during quality control may be compared with them.
Qualification Testing. 5.1. Without in any way limiting its warranty or incoming inspection testing rights under this Agreement, Buyer, from time to time, intends to subject samples of the purchased items to qualification tests. The tests will be sufficient to assure that the items meet all the specification requirements described in EXHIBIT C if any, as well as applicable drawings, samples and other descriptions. Buyer shall notify Seller of any deficiencies indicated by the testing. Seller shall at its own expense replace, alter, or modify the remaining to-be-delivered items so that they will pass subsequent qualification tests, unless Buyer elects, in writing, to waive a deficiency.
5.2. Should Seller fail to satisfactorily correct, at its own expense, any and all deficiencies discovered in Buyer's qualification testing within a reasonable time period after receiving Buyer's notice, then Buyer, at its sole option, shall have the right (i) to cancel all or any portion of the outstanding item orders without charge, and receive full credit at Seller's risk and expense all items which Seller previously delivered to Buyer.
Qualification Testing. Without in any way limiting its warranty or acceptance testing rights under this Agreement, Buyer intends to from time to time subject samples of Product to be purchased hereunder to additional testing by a mutually agreed upon testing facility to assure that said Product meets requirements of the specifications set forth in Exhibit "A." Buyer will reference the specifications listed in Exhibit "A" on Buyer's Purchase Orders as a method of communication of the specification of the Product to the Seller with each order for Product to be delivered to the locations specified in Exhibit "A". Buyer shall notify Seller of any deficiencies indicated by said testing and Seller shall at its own expense alter said items to be delivered hereunder so that they will perform to the requirement of the specifications as defined in Exhibit "A" (attached) unless Buyer has elected in writing to waive said deficiency. Buyer retains the right and option to purchase Product under this Agreement prior to completion of its qualification testing of said Product. In the event said qualification tests by a mutually agreed upon testing facility shall disclose deficiencies (deficiencies meaning not meeting agreed upon specification) in any Product to be purchased hereunder, Buyer at its options may require Seller to suspend further deliveries of said Product until such time as Seller shall have corrected said deficiencies at its own expense. o Seller agrees that it will repair, modify or replace at no cost to Buyer all of said nonconforming Product which has been delivered to Buyer pursuant to this Agreement within 60 days of receipt of Buyer's notice of deficiency. In the event that Seller shall fail to correct at its own expense any and all deficiencies within a reasonable period of time after receiving notice thereof from Buyer, Buyer shall have the right at its option to cancel all or any portion of its outstanding or completed orders for said items without charge and to return for full credit at Seller's expense all nonconforming Product delivered to Buyer within 90 days prior to the date upon which Seller received Buyer's notice of deficiency. Seller agrees that with respect to items now or anytime hereafter subject to this Agreement, it will make available to Buyer at no charge results of its quarterly SPC data, and in conjunction with each delivery, Seller shall also supply at no charge to Buyer, a Certificate of Compliance representing Product supplied hereunder.
