Redundancy Pay. 28.6.3 An employee who resigns during the period of notice is entitled to the same redundancy payments provided in this clause as if they had remained in the Council's employment until the expiry of the notice period.
(c) If an employee dies with 28.6.4 During a period of eligible notice of termination given by the Council, an employee shall be allowed up to one day off without loss of pay during each week of notice for the purpose of seeking other employment. Where required by the Council the employee shall provide proof of attendance at an interview.
28.6.5 A redundant employee shall be entitled to the payment of a job search allowance of up to the amount set out in the Allowances Table of this Agreement to meet expenses associated with seeking other employment subject to proof of expenditure or on production of an invoice, and/or other appropriate documentation. The employee’s entitlement to claim the job search allowance is limited to a period of up to 12 months from their termination of service with the Council or until the employee secures alternative employment, which ever is the sooner.
28.6.6 If the employee agrees to be redeployed by Council into a lower paid position, the employee's existing salary and conditions shall be maintained for a period equivalent to the amount of notice and redundancy pay that the employee would be entitled to under this Agreement. Provided that should the employee resign during the period of salary maintenance, as provided for by this subclause, the balance of any notice and redundancy pay that the employee would have been entitled that to for the remainder of the period of salary maintenance shall be paid on termination.
28.6.7 The Council shall, upon receipt of a request from an employee to redundancy payshow employment has been terminated, such redundancy pay entitlement will be paid provide to the estate employee a written statement specifying the period of the employee's employment and the classification or the type of work performed by the employee.
(d) Any period 28.6.8 The Council shall, upon receipt of service a request from an employee whose employment has been terminated, provide to the employee an "Employment Separation Certificate" in the form required by the Department of Social Security.
28.6.9 In the event that Council determines that a position is redundant, Council where practicable, shall firstly offer such redundancy on a voluntary basis.
28.6.10 Nothing in this Agreement shall be construed so as to require the reduction or alteration of more advantageous benefits or conditions which an employee may be entitled to under any existing redundancy arrangement, taken as a casual will not entitle whole, between the industry unions and the Councils bound by this Agreement.
28.6.11 Subject to an application by the Council and further order of any relevant Industrial Relations Commission, a Council may pay a lesser amount (or no amount) of severance pay than that contained in subclause 28.6.2 above if the Council obtains acceptable alternative employment for an employee.
28.6.12 Nothing in this clause shall restrict an employee with ten years service or more and Council from agreeing to accrue service in accordance with this clause for that periodfurther severance payments.
(e) Service as an apprentice will entitle an employee to accumulate credits towards the payment of a redundancy benefit in accordance with this clause if the employee completes an apprenticeship and remains in employment with that employer for a further 12 months.
(f) Contributions paid by the employer under this clause will be paid in accordance with the requirements of the Scheme’s trust deed.
(g) Upon termination the employee will, depending on the Scheme’s trust deed, be paid directly by the Scheme.

Redundancy Pay. A redundant employee 23.1 This clause reflects the provisions of the Containers Packaging Relocation and Retrenchment Agreement 1996 and applies to all employees of Kewdale Flexibles who are employed under this Agreement.
23.2 It will receive redundancy/severance payments apply to apprentices if they are terminated in respect a retrenchment program but it will not apply to an apprentice who is termination at the completion of all continuous service with the employer, calculated as follows: Period of continuous service with an employer Redundancy/Severance Pay 1 year his or more but her apprenticeship.
23.3 It does not apply to probationers who have been employed for less than 2 Years 2.4 six months.
23.4 The period of notice to individual employees shall be a minimum of four weeks’ pay plus, . The period of notice may be reduced by mutual agreement between the employee and the Manager. Payment in lieu of notice shall be made if the period of notice is not given.
23.5 Retrenched employees will be paid for all service in excess of 1 year, 1.75 hours pay per completed week continuous years of service up at the rate of 3.5 weeks for each year of service and pro-rata for completed months.
23.6 A "week's pay" is defined as the employee’s normal weekly plus any tooling and leading hand allowance which are paid to the employee.
23.7 Shift penalties, overtime payments and any other allowances are excluded.
23.8 The appropriate leave loading will be paid on all annual leave.

(f) Contributions paid by the employer under this clause Containers Packaging Superannuation Fund will be paid in accordance with the requirements Trust Deed.
23.12 Employees being retrenched will be allowed reasonable time off work to attend employment interviews provided prior notice is given and the time and place of the Scheme’s trust deedinterview are communicated.
(g) Upon termination 23.13 This clause applies only when an operation or part of an operation is being relocated to a site which is at least two kilometres from the old site:
i. Disturbance Allowance Each employee who relocates shall be paid: $300 three months after relocating $300 six months after relocating $300 nine months after relocating
ii. Travel Allowance In some instances there may be a case for a further allowance to defray the cost of additional travel during the first year of relocation. This matter will be resolved at the operation which is relocating.
23.14 This clause refers to hardship which arises from the relocation of an operation. When there is a relocation and a comparable position is provided at the new location an employee will not receive a retrenchment payment unless it can be demonstrated that the relocation will cause genuine hardship. An employee may present a case for hardship before the relocation or up to three months after the employee willhas relocated. A procedure for assessing hardship cases will be developed at the location and must include referral of the matter to an independent arbitrator as a last resort.
23.15 This clause refers to an employee who as an alternative to retrenchment is offered a position with another operation within the Amcor Group.
i. The employee can either accept the transfer or the retrenchment payments.
ii. If the employee accepts the transfer he/she will maintain continuity of service.
iii. If within three months of the date of transfer the employee terminates or the new employer terminates (other than in the case of dismissal for conduct which justifies instant dismissal) the above retrenchment payments, depending on less any relocation payment made, will apply. If any such adjustment is made, it will be done so as to lawfully minimise the Scheme’s trust deed, be paid directly tax Raid by the Schemeemployee.
(h) For the purpose of meeting its obligations under this clause the employer will make the contributions set out in clause 20 above on a monthly basis in respect of each employee covered by this Agreement to the Scheme.
(i) Where an employee is entitled to a payment by the Scheme under clause 20 and an entitlement under the provisions of this clause would be greater than the employee will receive the difference between the amount due under clause 20 and the amount due under this clause, but not both.

A redundant employee will receive redundancy/severance payments in respect of all continuous service with the employer, calculated as follows: Period of continuous service with an employer Redundancy/Severance Pay 1 year or more but less than 2 Years 2.4 weeks’ pay plus, for all service in excess of 1 year, 1.75 hours pay per completed week of service up to a maximum of 4.8 weeks’ pay 2 years or more but less than 3 Years 4.8 weeks’ pay plus, for all service Years in excess of 2 years, 1.6 hours pay per completed week of service up to a maximum of 7 weeks’ pay 3 years or more but less than 4 Years 7 weeks’ pay plus, for all service in excess of 3 years, 0.73 hours pay per completed week of service up to a maximum of 8 weeks’ pay 4 years or more 8 weeks’ pay
(a) Provided that an employee employed for less than 12 months will be entitled to a redundancy/severance payment of 1.75 hours per week of service if, and only if, redundancy is occasioned otherwise than by the employee.
(b) Week’s pay means the ordinary time rate of pay at the time of termination for the employee concerned.
(c) If an employee dies with a period of eligible service which would have entitled that employee to redundancy pay, such redundancy pay entitlement will be paid to the estate of the employee.
(d) Any period of service as a casual will not entitle an employee to accrue service in accordance with this clause for that period.
(e) Service as an apprentice will entitle an employee to accumulate credits towards the payment of a redundancy benefit in accordance with this clause if the employee completes an apprenticeship and remains in employment with that employer for a further 12 months.
(f) Contributions paid by the employer under this clause will be paid in accordance with the requirements of the Scheme’s trust deed.
(g) Upon termination the employee will, depending on the Scheme’s trust deed, be paid directly by the Scheme.
(h) For the purpose of meeting its obligations under this clause the employer will make the contributions set out in clause 20 above on a monthly basis in respect of each employee covered by this Agreement to the Scheme.
(i) Where an employee is entitled to a payment by the Scheme under clause 20 and an entitlement under the provisions of this clause would be greater than the employee will receive the difference between the amount due under clause 20 and the amount due under this clause, but not both.

(a) An employee who resigns during the period of notice is entitled to the same redundancy payments provided in this clause as if they had remained in KEE's employment until the expiry of the notice period.
(b) Week’s pay means During a period of notice of termination given by the ordinary time rate KEE, an employee will be allowed up to one day off without loss of pay at the time during each week of termination notice for the purpose of seeking other employment. Where required by KEE the employee concernedwill provide proof of attendance at an interview.
(c) If A redundant employee will be entitled to the payment of a job search allowance of up to $2,000 to meet expenses associated with seeking other employment subject to proof of expenditure or on production of an employee dies with invoice, and/or other appropriate documentation. The employee’s entitlement to claim the job search allowance is limited to a period of eligible up to 12 months from their termination of service which with KEE or until the employee secures alternative employment, whichever is the sooner.
(d) If the employee agrees to be redeployed by XXX into a lower paid position, the employee's existing salary and conditions will be maintained for a period equivalent to the amount of notice and redundancy pay that the employee would be entitled to under this Agreement. Provided that should the employee resign during the period of salary maintenance, as provided for by this subclause, the balance of any notice and redundancy pay that the employee would have been entitled that employee to redundancy pay, such redundancy pay entitlement for the remainder of the period of salary maintenance will be paid on termination.
(e) XXX will, upon receipt of a request from an employee to show employment has been terminated, provide to the estate employee a written statement specifying the period of the employee's employment and the classification or the type of work performed by the employee.
(df) Any period KEE will, upon receipt of service as a casual will not entitle request from an employee whose employment has been terminated, provide to accrue service in accordance with this clause for that period.
(e) Service as an apprentice will entitle an employee to accumulate credits towards the payment of a redundancy benefit in accordance with this clause if the employee completes an apprenticeship and remains "Employment Separation Certificate" in employment with that employer for a further 12 months.
(f) Contributions paid the form required by the employer under this clause will be paid in accordance with the requirements Department of the Scheme’s trust deedSocial Security.
(g) Upon termination In the employee willevent that KEE determines that a position is redundant, depending KEE where practicable, will firstly offer such redundancy on the Scheme’s trust deed, be paid directly by the Schemea voluntary basis.
(h) For Nothing in this agreement will be construed so as to require the purpose reduction or alteration of meeting its obligations more advantageous benefits or conditions which an employee may be entitled to under this clause any existing redundancy arrangement, taken as a whole, between the employer will make the contributions set out in clause 20 above on a monthly basis in respect of each employee covered union and KEE bound by this Agreement to the Schemeagreement.
(i) Where Subject to an application by XXX and further order of the Industrial Relations Commission of New South Wales, KEE may pay a lesser amount (or no amount) of severance pay than that contained in clause 37.6 (ii) above if KEE obtains acceptable alternative employment for an employee.
(j) Nothing in this clause will restrict an employee is entitled with ten years service or more and XXX from agreeing to a payment by the Scheme under clause 20 and an entitlement under the provisions of this clause would be greater than the employee will receive the difference between the amount due under clause 20 and the amount due under this clause, but not bothfurther severance payments.

(k) Subject to an application by the Scheme under clause 20 Service and further order of the Industrial Relations Commission of New South Wales, the Service may pay a lesser amount (or no amount) of severance pay than that contained in subclause (v) above if the Service obtains acceptable alternative employment for an entitlement under the provisions of this clause would be greater than the employee will receive the difference between the amount due under clause 20 and the amount due under this clause, but not bothemployee.
