Responsibility for maintaining the AMHP service. The Authority should provide a legal advice service for AMHPs. This service will offer legal advice in complex situations or where there is conflict between the AMHP and other agencies and support in making applications to the courts. If there is a legal conflict of interest between the Authority and the Trust, the Conflict of Interest Protocol will be implemented. The Authority should provide indemnity and vicarious liability insurance for all AMHPs approved and authorised by the Authority. This should be part of the Honorary Contract between the Authority and the AMHP. This responsibility is only for AMHPs who are acting on behalf of the Authority. With Article 5 of the Human Rights Act 1998, it is enshrined that liberty and security of a person is a universal right and when a person’s liberty is to be deprived this must be deemed as proportionate and necessary. The AMPH service will provide an effective, responsive and reliable service that meets the statutory duties and acts independently in the complex decision making required by MHA assessments in accordance with the MHA amended 2007 Code of Practice. Examples of where close joint working arrangements between the Authority Council and the Trust are required are: The Trust’s Workforce and Organisation Development Department need to maintain a list of employees who have AMHP approval or authorisation and use this to maintain an appropriate number of AMHPs and ensure appropriate standards are being met. This is needed because, while the Authority has a legal responsibility, the supervision, duty rota and day to day management of the AMHPs will be undertaken by the Trust. Re-approval and ongoing training arrangements should also be subject to joint arrangements between the Trust and the Authority. Re-approval arrangements are managed by the Trust’s Head of Social Work, acting on behalf of the Authority’s Director of Adult Social Care. Ongoing AMHP training is provided by the Trust’s Workforce and Organisational Development Team and by the Authority’s Workforce Development Team.
