Restorative justice and reconciliation. Restorative justice follows a different path from retribution. The conception of crime, and of the means to right the wrongs, is different. In this respect Xxxxxx Xxxx, one of the pioneers of restorative justice practices, argues that: “restorative justice views crime, first of all, as harm done to people and communities… A harm focus, however, implies a central concern for victims’ needs and roles. Restorative justice begins with a concern for victims and how to meet their needs, for repairing the harm as much as possible, both concretely and symbolically” (1997: 68). The main focus of restorative justice is on the victims and not on the breach of the law. This affirmation of the victims’ needs and roles, which derived principally from experiences in victim/offender mediation in the USA, represents a major difference from the process involved in retributive justice. There are various definitions of restorative justice; Xxxx Xxxxxxxx proposes a more general definition of restorative justice that it is “a process whereby parties with a stake in a specific offence collectively resolve how to deal with the aftermath of the offence and its implications for the future” (1999: 5). This definition suggests that the attainment of justice involves various concerned actors who must come together to resolve their conflicts and to envisage implications for the future. In cases of conflict, the most directly related individuals are the victims and victimizers. The potential contribution of restorative justice to interpersonal reconciliation is far more visible than that of retributive justice. The key principles of restorative justice lie in the idea that justice is not the monopoly of the state and its institutions but rather, as Xxxxxx Xxxx describes it, “crime is a violation or harm to people and relationships; the aim of justice is to identify obligations, to meet needs and to promote healing; and the process of justice involves victims, offenders, and the community in an effort to identify obligations and solutions, maximizing the exchange of information (dialogue, mutual agreement) between them” (1997: 69). Thus bringing together victims, victimizers and the community into a confrontation so that they can collectively resolve their conflict affords agency to the actors in the attainment of justice.   • Administrative Claims Requirements and Procedures No suit or arbitration shall be brought arising out of this Agreement against City unless a claim has first been presented in writing and filed with City and acted upon by City in accordance with the procedures set forth in Chapter 1.34 of the Chula Vista Municipal Code, as same may be amended, the provisions of which, including such policies and procedures used by City in the implementation of same, are incorporated herein by this reference.   • Termination in the Event of Financial Difficulties If the HSP makes an assignment, proposal, compromise, or arrangement for the benefit of creditors, or is petitioned into bankruptcy, or files for the appointment of a receiver the Funder will consult with the Director before determining whether this Agreement will be terminated. If the Funder terminates this Agreement because a person has exercised a security interest as contemplated by section 107 of the Act, the Funder would expect to enter into a service accountability agreement with the person exercising the security interest or the receiver or other agent acting on behalf of that person where the person has obtained the Director's approval under section 110 of the Act and has met all other relevant requirements of Applicable Law.

  • Submitting False Claims; Monetary Penalties The AOC shall be entitled to remedy any false claims, as defined in California Government Code section 12650 et seq., made to the AOC by the Contractor or any Subcontractor under the standards set forth in Government Code section 12650 et seq. Any Contractor or Subcontractor who submits a false claim shall be liable to the AOC for three times the amount of damages that the AOC sustains because of the false claim. A Contractor or Subcontractor who submits a false claim shall also be liable to the AOC for (a) the costs, including attorney fees, of a civil action brought to recover any of those penalties or damages, and (b) a civil penalty of up to $10,000 for each false claim.

  • Program Requirements Provided At No Charge to the Judicial Council A. The Contractor shall provide the following items during the Program at no charge to the Judicial Council:

  • Class, Collective and Representative Action Waiver THE PARTIES AGREE THAT COVERED CLAIMS WILL, AT EITHER PARTY’S ELECTION, ONLY BE ARBITRATED ON AN INDIVIDUAL BASIS AND THAT EACH WAIVES THE RIGHT TO PARTICIPATE IN OR RECEIVE COMPENSATION FROM ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. NO PARTY MAY BRING A CLAIM ON BEHALF OF OTHER INDIVIDUALS; ANY ARBITRATOR HEARING A COVERED CLAIM MAY NOT COMBINE MORE THAN ONE INDIVIDUAL’S CLAIM OR CLAIMS INTO A SINGLE CASE OR TO ARBITRATE ANY FORM OF A CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. SHOULD ANY PORTION OF THE FOREGOING WAIVER BE FOUND INVALID, THE REMAINING PORTION THAT IS VALID WILL BE ENFORCED TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.
