Restrictions on Use of Software. The Software may be used only for the commercial preparation and electronic filing of Tax Returns and processing of Bank Products. ALL OTHER USES ARE EXPRESSLY PROHIBITED.
Restrictions on Use of Software. You will not, except as provided in this Agreement: a) Copy, reproduce, distribute, transfer, rent, lend, loan, lease or sublicense any portion of the Software, or otherwise make the Software, its features or functionality available to any third party for any reason.
Restrictions on Use of Software. Subject to the terms and conditions for the applicable License Type, Licensee agrees that it will not, and will not permit any third party to, directly or indirectly: (i) copy the Software (except that Licensee may download and install the Software and make one (1) copy of the Software solely for backup purposes) or create derivative works based on the Software; (ii) assign, transfer, lease, rent, sublicense, distribute or otherwise make available the Software, any Entitlement, any License or any right granted under this Agreement, in whole or in part, to any other Person, including on a timesharing, software-as-a-service or other similar basis (except that, with certain License Types, Licensee may permit third party Authorized Users to Use the Software to create content for Licensee); (iii) permit any third party, other than an Authorized User, to redeem or un-redeem Entitlements, install Licenses or Use the Software; (iv) share any user ids or passwords with anyone other than Authorized Users; (v) Use the Software to provide any service bureau services or any services on a similar basis; (vi) except as provided under Section 3.10, Use the Software under a Non-Commercial License for Commercial purposes, or receive any form of compensation for work product created or work performed Using the Software under a Non-Commercial License; (vii) reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of any portion of the Software; (viii) disassemble, reverse engineer or use the file format of any file generated by the Software for purposes of by-passing any restrictions or requirements of the Software; (ix) attempt to tamper with, alter, disable, hinder, by-pass, override, or circumvent any security, reliability, integrity, accounting or other mechanism, restriction or requirement of the Software, including any Entitlement or License or any other mechanism that permits, monitors or limits installation of Licenses or Use of the Software to the applicable scope in accordance with this Agreement; (x) convert the file format of any file generated by the Software when licensed under a Non-Commercial License to a file format generated by the Software when licensed under a Commercial License; (xi) attempt to tamper with or alter (or with respect to Non-Commercial Licenses, hinder) the usage information conveyed by the Software to SideFX; (xii) modify or attempt to modify the Software; (xiii) install or Use the Software in any way that ...
Restrictions on Use of Software. USER shall not: (i) modify, translate, reverse engineer, decompile, disassemble, create derivative works based on, or duplicate or copy the Software or any portion thereof, other than as provided in Section 4; (ii) sublicense, loan, rent, transfer or grant any rights in the Software to any third party; (iii) remove any proprietary notices, labels or marks in or on the Software; or (iv) use the Software for any purpose other than as authorized in Section 3. BAPCo retains the right to terminate this license and authority immediately upon notice to USER at its discretion, without refund of the purchase price, on the basis of reasonable evidence that USER, including any of USER’s personnel, agents or representatives, has breached any of such conditions or restrictions or has permitted or facilitated any third party in doing so.

Licensee may not (a) make the Software available for use by others in any service bureau or similar arrangement; (b) distribute, sublicense, transfer, or lend the Software to any third party; or (c) disassemble or reverse engineer (except in European Union countries, to the extent allowed by law) the Software. Licensee may copy the Software solely for backup/archival purposes, provided that Licensee includes all copyright and similar rights notices. Licensor (or its licensor) retains all right, title, and interest in the Software (and in all copies). Unauthorized copying and modification of the Software is not permitted. Licensee acknowledges that the Software may contain license management functionality, including but not limited to node-locking, user counting, expiring licenses, silent activations (with or without user intervention) and the like. Licensor asserts that its use of such license management functionality is generally limited to ensuring adherence to its license agreements/models and not generally for purposes of “self-help.” The Software contains the User State Migration Tool (“USMT”). USMT is a copyrighted component licensed from Microsoft. Licensee’s use of this component requires Licensee to have a validly licensed copy of the underlying Windows operating system.
Restrictions on Use of Software. You may not publish, display, disclose, rent, lease, sublease, modify, loan, distribute, or create derivative works based on the Software or any part thereof. You may not reverse engineer, decompile, translate, adapt, or disassemble the Software, nor shall You attempt to determine the source code from the object code for the Software. You shall not transmit the Software over any network or between any devices, although You may use the Software to make such transmissions of other materials. Rather, You have a license to use the Company as long as this Agreement remains in full force and effect. Ownership of the Application, Documentation and all intellectual property rights therein shall remain at all times with Company. Any other use of the Software or the Company's products and services by any person, business, corporation, government organization or any other entity is strictly forbidden and is a violation of this Agreement. You hereby acknowledge that the Software and all other products listed on Company's website are the proprietary property of Company. The names and marks associated with all products and services identified and all associated names, marks and logos (collectively, the "Marks") are the trademarks and/or service marks of Company or its affiliates, and that any trade dress, trademarks, service marks or designs related to Company and/or the Marks are the intellectual property of Company and are protected by United States copyright laws, trademark laws, trade secret laws, international treaties and applicable laws of the states and jurisdictions where they are used. This Agreement does not grant to You any ownership rights in the Marks or in any other intellectual property of Company. All right, title and interest in and to the Marks, and any other intellectual property of the Company shall remain with Company. You further acknowledge that the Software and all products and its functionality, structure and organization, and the code format of the Software are valuable confidential trade secrets of Company.

Restrictions on Use of Software. Customer's use of the Software is subject to the following restrictions. Except as expressly permitted in this Agreement, Customer shall not, and shall not permit others to, (a) use, modify, copy (except for one back-up copy containing Engage's copyright notices and other proprietary marks), or otherwise reproduce the Software in whole or in part; (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code form or structure of the Software; (c) distribute, sublicense, assign, share, timeshare, sell, rent, lease, grant a security interest in, use for Service Bureau purposes, or otherwise transfer the Software or Customer's right to use the Software; or (d) remove any proprietary notices or labels on the Software. All rights not expressly granted to Customer are reserved by Engage. There are no implied rights. Customer shall install the Software only on Enterprise Servers and/or Engines, as the case may be, located in the country specified on the Cover Page. Customer shall be responsible for ensuring that its Average Daily Ads served or Page Requests does not exceed the number permitted for the Applicable Tier (an "Overage"), and Customer shall promptly report any Overage to Engage, which shall have the right to require Customer to upgrade its Tier.

If you have a license to the InstallAnywhere Collaboration or InstallAnywhere Enterprise, you may use the Software for the purposes of creating unit test installations for your own exclusive use. You may use the software as a plug-in to the Eclipse Open Source IDE. Licensor is not licensing to you any right, title, and interest with respect to the Eclipse Open Source IDE; your use of the Eclipse Open Source IDE is subject to your acceptance of the terms and conditions of the end-user license agreement from Eclipse Foundation for that product. You acknowledge that the Software does or will contain license management functionality, including but not limited to node-locking, user counting, expiring licenses, silent activations (with or without user intervention) and the like. Licensor asserts that its use of such license management functionality is generally limited to ensuring adherence to its license agreements/models and not generally for purposes of “self-help.”
