RIGHT TO TEMPORARILY SUSPEND YOUR RIGHT TO OCCUPY. 13.1 In addition to our right to terminate this Licence Agreement pursuant to clause 16, we reserve the right, entirely at the discretion of the University to suspend this Agreement (instead of terminating it) upon giving you not less than four weeks’ notice and require you to vacate the Accommodation immediately on expiry of such notice, in the event of a breach of your obligations under this Agreement (which includes committing a breach of the University Regulations giving rise to suspension from the University) or if we reasonably suspect you to be in breach of your obligations under this Agreement.

RIGHT TO TEMPORARILY SUSPEND YOUR RIGHT TO OCCUPY. If you have committed, or we reasonably suspect that you have committed, a serious breach of your obligations under this Contract (or you are in serious breach of the University Regulations that we reasonably consider that suspension from your accommodation is necessary), we may suspend you from the Accommodation during appropriate investigations of the breach or the suspected breach. We will only suspend you if we consider (acting reasonably) that your continued presence in the Accommodation, Residence or Residential Grounds will constitute a threat to life, limb or wellbeing of any person and/or may involve criminal damage/activity to property. If, under the University Regulations as to the Discipline of Students, you are suspended, you may also be suspended from the Accommodation. During such suspension, we are under no obligation to provide you with any alternative accommodation.

Any decision to suspend you will be made in accordance with the procedure set out in the Halls Handbook and be subject to your right to appeal which is set out within the College Regulations. During this suspension, the College is under no obligation to provide you with any replacement accommodation. Learners under the age of 18 will in all cases be repatriated to their home address, or other reasonable place of safety by the College, working in conjunction with the residents’ parent, guardian or legal xxxx. Procedure for dealing with breaches Procedure If you or your invited guests breach any of the conditions of this Agreement then, depending upon the nature of the breach and/or the seriousness of the breach, action may be taken against you under the procedure set out in clauses 37.2 and 37.3 below When identifying or becoming aware of any breach by you of the terms of this Agreement, the General Soft Services Manager will decide whether to: take no further action; or discuss the breach with you informally; and/or take further action in accordance with clauses 37.3 under this Agreement. Except in the circumstances set out in paragraph 37.2.1, 37.2.2 and 38.1 breaches of this Agreement will be dealt with as follows: the General Soft Services Manager will investigate the alleged breach (any previous breaches and sanctions will be taken into account) and will invite you to a meeting and draw the alleged breach to your attention; you will be given an opportunity to respond to any allegation, and if necessary time to gather evidence, witnesses and information. at the conclusion of this process, or if without good reason you fail to engage with the process, we will decide (acting reasonably) whether you have committed the alleged breach and, if so, whether to: issue you a verbal warning (confirmed in writing); or issue you an official reprimand or a written warning if you have received a reprimand in the previous 12 weeks; or issue you a written warning; or issue you a final written warning (which will be issued if you have already received a written warn...

  • Right to Occupy This Contract is for an assigned Space in University Housing and not for a specific accommodation, Unit or Building. It is UHRL’s agreement to provide Resident with access to a Space in University Housing for residential purposes, together with any installed fixtures and provided furnishings, plus shared use of their Unit and of the Building common areas. This Contract is not a lease or license and does not create any property interest or tenancy rights in any Building or in any particular Unit or Space.
