Rights of Employee on Unpaid Leave Sample Clauses

Rights of Employee on Unpaid Leave. (1) An employee may bid on a vacant bargaining unit position on a qualified seniority preference basis while on any type of disability leave, including worker's compensation, if the employee's disability does not preclude him from returning to work on the anticipated starting date on the posting without restrictions. If an employee exercises this right and thereafter is determined the most senior qualified applicant, the Board may require the employee to provide sufficient medical information to verify his/her ability to perform the essential duties of the new position and to return to work without restrictions.
