Rights on Transfer. 34.01 An Employee who has completed their probationary period and who, by way of the Employee’s request, is promoted or transferred to another position and within three (3) months if their classification is Grade Level 5 or lower or six (6) months if their classification is Grade Level 6 or greater, is found to be unsuitable, will be placed in another position for which the Employee possesses the necessary qualifications provided such a position is available.
34.02 In the event that such a position is not available, the Employee's service with the University shall be terminated and upon termination, the Employee shall be granted:
(a) an amount equivalent to one (1) month's salary at the Employee’s regular rate, and
(b) a further amount equivalent to one (1) month's salary at the Employee’s regular rate for each full year of service to a maximum amount equivalent to three (3) months of salary.

Rights on Transfer. In the event that Drayton Entertainment proposes to transfer the complex or any interest therein to a proposed transferee, Drayton Entertainment shall provide the Municipality of South Huron notice of the name and identity of the proposed transferee, and the proposed closing date reasonably prior to the closing thereof but no less than sixty (60) days' prior to the proposed closing date of the transfer. Drayton Entertainment shall provide, as a condition to the consummation of such transfer, that the proposed transferee shall expressly assume all obligations of Drayton Entertainment under this Agreement; provided, however, that such proposed transferee shall be deemed to have acquired the complex subject to this Agreement and to have assumed the obligations of Drayton Entertainment hereunder. All exclusivity and recognition arrangements and contracts to which such proposed transferee is a party shall be subordinate to this Agreement and Drayton Entertainment shall ensure that the purchase and sale agreement for the transfer of the complex license or any interest therein shall provide for such subordination.

A Regular, Sessional, or Recurring Part-time Employee who has completed the probationary period and who is promoted or transferred to another Position other than at the Employee’s own request, and within a three (3) month trial period is found to be unsuitable, will be returned to the former Position, if available, or to another Position for which the Employee is qualified, at the Employee’s former salary.
Rights on Transfer. If any Stockholder desires or is required to make any Transfer, before such Transfer may be made, the Company shall have the right (but not the obligation) to purchase, at the Purchase Price (as defined in Section 4) and under the terms and conditions specified herein, any and all of the Shares potentially subject to such Transfer.

44.02 An Employee who has completed the probationary period and who requests and is then promoted or transferred to another Position and within a three (3) month trial period is found to be unsuitable will be offered:
(a) return to the former Position; or
(b) another Position for which the Employee possesses the necessary qualifications; provided that such a Position is available. Consultation with the employee on position availability and options will occur. If a Position is not available, the Employee shall be eligible for the rights under Article 40, Position Abolishment.
44.03 At least five (5) work days prior to the trial period end date, the Board may seek one (1) extension of the trial period to a maximum of three (3) months. Where the Board is seeking an extension, the Employee will be provided with a written overview of performance requirements identifying areas for improvement and a written copy of the request that was sent to the Union. The trial period may be extended by mutual agreement between the Union and the Employer with the Union providing written notice of the decision to the Employee by the trial period end date.
Rights on Transfer. There are no contractual arrangements entitling any of the Broadcast Employees as against any member of the Broadcast Group to any payments, changes to terms of employment or other benefits arising from the Separation or the sale of the NatTrans Shares.
Rights on Transfer. The only payments which may be made by any Group member or the UK Employer to any Employee in connection with the sale or transfer of the Group or any Group member arises pursuant to the change of control provisions of the Baring Asset Management Holdings Limited Group Profit Sharing Scheme and Long Term Incentive Plan.
