This Agreement shall apply with respect to all of the Corporation’s employees comprised within the unit prescribed by The Alberta Labour Relations Board Certificate or said certificate as it may be amended from time to time The Corporation the Association as the exclusive bargaining agent for all employees as defined in the Alberta Labour Relations Board as referred to in Article or said certificate as it may be amended from time to time. It is agreed that Casual employees shall not be included within the scope of this Collective Agreement. A Casual employee is defined as an employee who does not work more than hours within any three calendar month period. OF CATEGORIES employees covered by this Collective Agreement shall fall into the following categories: Permanent employees, Probationary employees or Seasonal employees. A Permanent employee shall be an employee who has been appointed by written notice to a permanently established position following the successful completion of a one hundred and eighty day probationary period. The parties agree that any Seasonal employee who completes four hundred and fifty calendar days of continuous employment shall achieve Permanent employee status except when the Seasonal employee is specifically to accommodate maternity leave, adoption leave, parental leave, sick leave and Workers’ Compensation Board situations. In situations accommodating maternity leave, adoption leave, leave, sick leave and Workers’ Compensation Board, Permanent employee status shall be achieved after completion of nine hundred calendar clays of continuous employment. Appointment to a Permanent category shall be communicated to the employee and the Association in writing within seven calendar days of appointment. A Probationary employee shall be either: A new employee appointed to a permanently established position, for whom there shall be a one hundred and eighty calendar day trial period, during which period his employment may be terminated at Management’s discreetion. A review of the performance of such employee will be discussed with him during the final thirty days of the trial period. The Hospital recognizes the Union as the bargaining agent for a l l employees of The General Hospital i n Ontario, regularly employed for not more than hours per week and students employed during the school vacation period, save and supervisors, persons above the rank of supervisor, professional staff, office, cleri- cal and technical staff and persons covered by subsisting agree- ments.
AND RECOGNITION. All medical laboratory technologists and technicians, all technologists and technicians, physiotherapists, respiratory therapists and dietitians, pharmacy technicians, the Discharge Planning Officer, and students employed during the school vacation period employed by Memorial Hospital in Ontario, save and except assistant technical directors and co-ordinators, supervisors, persons above the rank of all other technical employees and persons covered by other subsisting collective agreements. The parties declare that the combined bargaining units described above does not expand the bargaining rights of the applicant trade union to include any unrepresented employees of the employer. The Union acknowledges that it is the exclusive right and function of the Employer subject to the terms of this Agreement: To direct the working forces, to discharge employees for just cause, to promote, demote, transfer, layoff, suspend or otherwise discipline employees subject to the use of the Grievance Procedure, and to hire, Generally to manage the Hospital and all the enterprises in which the Hospital is engaged. To maintain order, discipline and efficiency and to make and alter from time to time, rules and regulations to be observed not inconsistent with the provisions of this Agreement. It is agreed that the Employer may exercise any of the rights, powers and functions or authority which the Employer had prior to the signing of this Agreement except those rights, powers, functions or authority which are specifically abridged or modified by this Agreement and these rights shall be exercised in a manner inconsistent with the express provisions of this Agreement. Government sponsored programs may be made available to Employer from time to time, therefore, the Employer may hire persons in accordance with the terms of programs at a rate of pay stipulated by the program. Such persons not be included in the bargaining unit. The Local Union President shall be notified when a program available to the Ernployer, its duration and the persons to be utilized. It is understood that there will be no reduction in bargaining unit hours as a result of such programs.

The Employer undertakes that he will not enter into any other agreement or contract with those employees for whom the Union has bargaining rights either individually or collectively which will conflict with any of the provisions of this Agreement. Where the feminine pronoun is used in this Agreement, it shall mean and include the masculine pronoun where the context so applies. Where the singular is used, it may also be deemed to mean the plural, within the appropriate context. Any reference to doctor will include, where appropriate, nurse practitioner.

The Hospital recognizes the Union as the exclusive bar- gaining agent for all its employees Metropolitan Toronto, save and except supervisors, persons above the rank of super- visor, registered nurses, graduate nurses, undergraduate nurses, paramedical personnel, scientific staff, persons engaged in research work, office and clerical staff, persons regularly employed for not more than twenty-four (24) hours per week and students employed during the school vacation period.

The Hospital recognizes the Union as the exclusive bargaining agent with respect to all matters properly arising under this Agreement for all office and clerical employees employed by the Hospital in the City of Toronto, save and except supervisors, persons above the rank of supervisor, persons in positions listed in the Clarity Note, persons employed by the Orthopaedic Arthritic Hospital Foundation,the Sunnybrook Foundation, persons in Research, personsworking at the Sunnybrook Estates, persons working at the Sunnybrook Creche, and persons working in Human Resources. Clarity Note: The parties agree that the following positions are not included in the bargaining unit: Executive Assistant, Secretary to the Board, Assistant Occupational Health, Secretary to Director,Administrative Assistant, Secretary to Vice-president, Secretaryto Medical Chief, Executive Secretary, Data Analyst, Secretary to Chief Financial Assistant to Chief Nursing Officer, Assistant to Associate Chair Research, Assistant to Director Medical Education. ARTICLE MANAGEMENT RIGHTS The Union acknowledges that it is the exclusive function of the Hospitalto: maintain order, discipline and efficiency; hire, assign, retire, discharge, direct, classify,transfer, promote, demote, layoff and suspend or otherwise discipline employees for just cause; establish and enforce rules and regulations to be observed by the employees, provided that they are not inconsistent with the provisions of this Agreement; generally to manage and operate the Hospital in all respects in accordance with its obligations and without restricting the generality of the foregoing to determine the kinds and locationsof machines, methods and procedures, equipment to be used, the allocation and number of employees required from time to time, overtime, the standards of performance for all employees and all other matters concerning the Hospital's operations, not otherwise specifically dealt with elsewhere in this Agreement.

The Hospital the Union as the sole and exclusive bargaining agent for all Medical Laboratory, Radiology and Nuclear Medicine Technologists, Technicians and Assistants employed by the Hospital in save and except Assistant Chief Technologist and those above the rank Assistant Chief Technologist, Clinical Instructor, students in training, students employed during the school vacation period, office and clerical employees, employees covered by subsisting labour agreements and persons regularly employed for not more than twenty-four (24) hours per week.
