Risk of Data Loss. When Data is in ShopKo's possession or under ShopKo's control and an event occurs that prevents or hinders the access to or reliable use of such data, ShopKo shall use reasonable efforts to cure and re-create or restore such data as promptly as practicable.

Risk of Data Loss. When VITA Data is in the Supplier’s possession or under the Supplier’s control and an event occurs that prevents or hinders the access to or reliable use of such VITA Data, the Supplier will re-create or restore such data immediately, or in any case, as soon as reasonably practicable, to the last scheduled back-up applicable to such VITA Data in accordance with the Supplier’s back-up responsibilities hereunder. Any such re-creation or restoration will be at the Supplier’s expense and VITA will not be subject to any charge in connection therewith.
Risk of Data Loss. Should any Program Data be lost or destroyed due to any negligent act or omission of Provider or any other breach of the security obligations of this Agreement, Provider will be responsible at its own expense for the prompt reconstruction of such Program Data with high priority allocation of time and resources to complete the regeneration as quickly as possible.

All Student Code of Conduct guidelines are applied when communicating with Orangefield ISD student email.
Risk of Data Loss. RCS cannot be held responsible for data loss from any and all causes, or in any way related to or resulting from the repair or service of computer hardware, software or other equipment beyond RCS’s control. COP agrees to bear full responsibility for all data backup prior to any repair or service of computer hardware, software or other equipment by RCS. If a Data Loss Event results from a NTT DATA Excuse (other than a NTT DATA Excuse resulting from a Force Majeure Event), then NTT DATA may charge GPI for actual costs incurred by NTT DATA in re-creating and restoring the data to the extent such costs result from activities in addition to the Responsibilities NTT DATA is obligated to perform in accordance with the applicable Statement of Work. In the case of each of the foregoing events, NTT DATA will consult with GPI before performing such re-creation or restoration, and GPI may, at its discretion, direct NTT DATA not to restore or recreate the data.
Risk of Data Loss. You understand that in the use of Software, including but not limited to the transmission and storage of data, that there is a risk that your data and information stored or saved by you by way of Software, may be lost and not recoverable. You agree that you assume sole responsibility for protecting against such loss of data or information by regularly making and maintaining complete and up-to-date backup copies of all data, information and files on an alternative type of storage medium, and that GFC has no responsibility or liability therefore whatsoever. You acknowledge that such back up procedures should be performed on at least a daily basis. Risk of Data Loss. When GTA Data is in Contractor’s possession or under Contractor’s control and an event occurs that prevents or hinders the access to or reliable use of such GTA Data, Contractor will re- create or restore such data immediately, or in any case, as soon as reasonably practicable, to the last scheduled back- up applicable to such GTA Data in accordance with Contractor’s responsibilities under the Agreement. Any such re-creation or restoration will be at Contractor’s expense and GTA will not be subject to any charge in connection therewith.
Risk of Data Loss. Supplier shall, consistent with scope of Assets for which Supplier has operational responsibility under the Asset Allocation Matrix or other portion of the applicable Statement(s) of Work, develop and maintain appropriate security procedures, policies and internal controls against the destruction, loss or alteration of Customer Data in the possession of Supplier, which procedures shall be (i) for Supplier Locations no less than industry standard and (ii) for Customer Locations, no less rigorous than the procedures utilized by Customer at such locations as of the Statement of Work Commencement Date, and shall include the creation of backup data and such other plans and procedures as may be implemented from time to time in accordance with the Procedures Manual. When Customer Data is in Supplier’s possession or under Supplier’s control and an event occurs that prevents or hinders the access to or reliable use of such Customer Data, Supplier will re-create or restore such data promptly, or in any case, as soon as reasonably practicable using generally accepted data restoration techniques, including utilization of last available back-up. Supplier will not charge Customer for the re-creation or restoration of such data, if such re-creation or restoration is required solely because of an error by Supplier or is otherwise necessitated as the result of an act or omission by Supplier in violation of its obligations under this Agreement. Otherwise, Supplier may charge Customer for actual personnel and other costs incurred by Supplier in re-creating and restoring the data; provided, however, that Supplier will consult with Customer before performing such re-creation or restoration, and Customer may, at its discretion, direct Supplier not to restore or recreate the data.
Risk of Data Loss. In the event any Program Data may be lost or destroyed through (i) any act or omission of Parent, its employees or agents or (ii) any breach of security or other obligations of this Agreement, including any breach of applicable law, by Parent, Parent will be responsible at its own expense for the prompt reconstruction of such. Program Data with high priority allocation of time and resources to complete the regeneration as quickly as possible.
