Disaster Recovery Services. No Party shall be required to provide disaster recovery Services to the extent that the Party that would receive such Services has materially altered the equipment, hardware or software to which such disaster recovery Services pertain.

Disaster Recovery Services. The Operator shall provide the Disaster recovery Services in accordance with Schedule 10 (Disaster Recovery) throughout the Term.
Disaster Recovery Services. Provider will provide Disaster Recovery Services pertaining to the Services in accordance with the DISASTER RECOVERY SCHEDULE. Company shall provide reasonable assistance and cooperation to support Provider's efforts to deliver such Disaster Recovery Services. Company shall retain responsibility to perform its obligations in accordance with the DISASTER RECOVERY SCHEDULE.
Disaster Recovery Services. There are two (2) distinct Resource Unit categories for Disaster Recovery (DR)
Disaster Recovery Services. Disaster Recovery Services are invoiced annually in advance upon our receipt of your data. Disaster Recovery services will renew automatically for additional one (1) year terms at our then-current Disaster Recovery fee, unless terminated in writing by either party at least thirty (30) days prior to the end of the then-current term.
Disaster Recovery Services. Vendor shall at all times maintain disaster recovery and business continuity plans consistent with the highest industry standards and sufficient to meet its obligations under this Agreement (“Disaster Recovery Plan”) The Disaster Recovery Plan shall address and protect the Judicial Council’s critical information technology environment. Individual Statements of Work may contain more specific obligations with respect to disaster recovery and business continuity. If a Statement of Work includes specific disaster recovery or business continuity obligations, and in the event of disaster, Vendor is not able to reinstate the applicable Services within the specified recovery time objectives, then Judicial Council may, upon written notice to Vendor, terminate the applicable Statement of Work as of the termination date specified in the notice, without cost or penalty. The Judicial Council may (at any time, and from time to time, during the Term) identify and notify the Vendor in writing of other items that the Judicial Council reasonably deems appropriate for inclusion in the Disaster Recovery Plan. The Vendor shall revise the Disaster Recovery Plan as appropriate to reflect any changes to the Judicial Council’s information technology environment, or related requirements, and submit such revised Disaster Recovery Plan to the Judicial Council for review, comment, and approval. The occurrence of a Force Majeure Event shall not relieve the Vendor of its obligations to provide services pursuant to this Section and in accordance with the Disaster Recovery Plan, except in the event and to the extent that such Force Majeure Event, or another Force Majeure Event, materially and adversely affects or prevents the performance of such services. Except as provided in the immediately preceding sentence, and notwithstanding any other provisions related to the occurrence of a Force Majeure Event or anything else to the contrary in this Agreement, any breach or violation by the Vendor of its obligations regarding execution of the Disaster Recovery Program during a disaster shall be deemed an incurable and material breach of this Agreement by the Vendor. Disaster Recovery Services. 4.1 The Operator shall ensure that the Services are available within twenty four (24) hours after the declaration of a Disaster in accordance with Paragraph 5.
4.2 The Operator shall provide and maintain (at appropriate levels of standby readiness) such infrastructure, equipment, hardware, software (including appropriate licences), documents, personnel and any other goods and services as is necessary to fulfil its obligations under this Schedule and provide the Disaster recovery Services (including, for the avoidance of doubt, to ensure it is able to comply with its obligations in the Disaster Recovery Plan in the event of a Disaster).
4.3 In the event of any change to the Disaster Recovery Plan, the Operator shall ensure that it implements such changes as may be necessary to ensure it continues to comply with the requirement in Paragraph 4.2.
4.4 The Operator shall ensure that any third parties whose services would be required in the event of a Disaster are approved by the Authority as Material Sub-Contractors in accordance with Clause 35 and, unless otherwise agreed by the Authority, are contracted to provide the relevant services throughout the Term of this Agreement.
Disaster Recovery Services. In the event of a disaster or system failure, the Solution shall provide disaster recovery services, including backup and a disaster recovery plan ensuring business continuity.
Disaster Recovery Services. If specified as applicable in the Order Email Confirmation, the Service Provider shall provide Disaster Recovery Services using Azure Site Recovery
1. 2. Subject to payment of the Service Provider’s charges that will be quoted from time to time, support work will be available outside Normal Working Hours to those with Standard Support.
3. You will pay the Service Provider’s charges monthly in arrears at the rates prevailing at the time the relevant support work and/or site visits are requested by You and carried out by the Service Provider for support work services which fall outside the scope of the Services contracted for by You pursuant to this Agreement.
4. Whilst creating new users and deleting old users comprises part of the Services, charges will be made if the Service Provider’s staff have to perform an account clean up or to manage the leaving user’s data.
