SAFETY CONDITIONS OF EMPLOYMENT. A. Within legal limitations, the District shall give legal support and other assistance as described in this paragraph for any assault or battery upon the teacher while acting in the discharge of his/her duties. 1. Teachers shall immediately report an assault or battery suffered by them in connection with their employment to their principal or immediate supervisor and may file a formal police report. 2. The District shall notify the teacher of its readiness to assist the teacher, upon request, as follows: a. By obtaining from policy relevant information as may be released concerning the accused. b. By providing the teacher with representation in court appearances, and by acting in appropriate ways as liaison between teacher, immediate supervisor, police, and the courts. 3. When absence arises out of or from such assault or injury, the teacher shall utilize industrial accident/injury leave in accordance with provisions of law. 4. Health and Welfare Benefits and/or Leave Benefits derived under this, or subsequent agreements, shall continue in accordance with this Agreement.

When bargaining unit members are assigned to be on campus at times other than during normal business hours, the site administrator will determine whether additional safety precautions are necessary. 12.3 In situations that fall within the scope of District employment, unit members may use reasonable force and means to protect themselves from attack, protect other persons or property from attack, quell a disturbance threatening physical injury to others, or obtain possession of weapons upon the person or within the control of another. 12.4 Unit members shall immediately report any assaults cases of assault or verbal abuse suffered by them in connection with his/her their employment to their immediate supervisor. 12.4.1 A unit member shall be entitled, upon written request, to reasonable and non­confidential information in the possession of the District relating to the incident or persons involved in the assault or verbal abuse; the District may act in appropriate ways as liaison between the unit member, the police and the courts in such situations. 12.4.2 A teacher may lawfully suspend any pupil from the teacher's class for any of the acts enumerated in Education Code Section 48900 and/or District policy for the day of the suspension and the day following. The pupil shall not be returned to the class from which he or she was suspended during the period of the suspension, without the concurrence of the teacher of the class and the principal. 12.4.3 A pupil suspended from class shall not be placed in another regular class during the period of suspension. However, if the pupil is assigned to more than one class per day, this subdivision shall apply only to other regular classes scheduled at the same time as the class from which the pupil was suspended. 12.4.4 A teacher may request that also refer a pupil for any of the acts enumerated in Section 48900 and/or District policy to the principal institute or the principal's designee for consideration of a suspension procedures in accordance with District policyfrom the school. 512.4.5 Teachers will be informed of a student who is subject to reporting according to Education Code § 49076 and the report is made available in a timely fashion to the District/School. Teachers may at any time request information about students provided that it is done in compliance with Education Code § 49076. 12.5 As defined herein, the District shall reimburse a unit member up to $200.00 for any out­of­ pocket loss, damage or destruction of personal property of the unit member sustained in situations that fall within the scope of District employment. A unit member may petition the Board for reimbursement beyond the stated limits. 12.5.1 For the intent of this section "personal property" is defined as eyeglasses, hearing aids, dentures, watches, or articles of clothing. "Personal property" may also include unit member owned materials or equipment utilized with prior written approval of the District. Appropriate reports to law enforcement agencies shall be filed by the unit member in case of stolen property. 12.5.2 A unit member filing a claim pursuant to this section shall file said claim on the District­prepared claim form no later than two (2) working days following the damage or loss of property in question. The District's "Student Discipline Policy" District retains the right to inspect all damaged property and to require full disclosure of witnesses, prior conditions, and full description and/or serial numbers of damaged or stolen property. 12.6 A District Handbook for Parents shall be made available distributed to employeesunit members and parents at the beginning of each school year. 12.7 The District shall issue a statement on cleanliness acknowledging its concern, and begin an immediate program to resolve the problem. 12.8 The District agrees to institute a system of visitor registration which requires identification for on­campus visitors and an office check­in procedure. Signs indicating the legal requirement to check in with the office will be prominently displayed.

SAFETY CONDITIONS OF EMPLOYMENT. A. The District shall provide safe working conditions in accordance with Federal and its employees State requirements. The District shall provide a legal defense for an employee in any litigation brought against an employee while acting within the scope of his/her employment, as soon as possibleprovided by the Government Code and applicable insurance policy provisions. SAFETY CONDITIONS OF EMPLOYMENT. A. The District Safety and its employees shall be safety conscious in their conduct and actions and shall cooperate in the implementation of the District's safety program.Health B. Employees shall report any unsafe or unhealthy conditions directly to their supervisor1. The District shall conduct investigations of employee reports provide a work place which is safe for its employees in compliance with federal and take appropriate measures as soon as possiblestate law. In addition to compliance to such laws, the District shall also base safety provisions in federal, state, county, and city guidelines and mandates. It shall maintain an open administrative office during all times when classes are in session at all colleges (the District will retain its management right to determine staffing at these offices) to address “safety” and all public health concerns. The employee purpose of this office will be to deal with emergencies from the staff, public, and students for which other resources are not available. The District and the Association shall be informed collaborate toward the objective of eliminating accidents and health hazards under state and federal law. The Association recognizes their members’ obligations and rights under existing federal and state laws with regard to safety and health matters. 2. The District shall maintain a Safety Committee. The Association shall have the right to appoint at least four representatives from the bargaining unit to this committee, one from each college and the Association President or designee. 3. The District shall provide appropriate safety guidelines for faculty members who handle hazardous materials in the course of their normal job duties. 4. The District will provide appropriate supplies and equipment needed by faculty to implement safe working conditions, including all personal protective wear needed by faculty in the principal or designee course of their normal job duties. 5.
