15.4 When absence arises out of or from such assault or injury, the terms and conditions of the Workers’ Compensation Insurance and appropriate leave provisions of this Agreement shall apply, except that the maximum amount of Industrial Accident Leave shall be expanded to one hundred twenty (120) work days.
15.5 A unit member shall report to the immediate Supervisor any expulsion hearing condition which he/she believes to endanger his/her health or safety. Such report shall be in writing, or shall be presented verbally, followed as soon as practicable by a written report. The Supervisor shall take responsive, reasonable, and appropriate action and shall so inform the employee in writing.
15.6 The following shall be encouraged the procedure followed for the administration of medication and medical services to students:
15.6.1 The parent must submit a written request to the program administrator requesting that the teacher provide the service. Such service to pupils shall be done only in exceptional circumstances wherein the child’s health may be jeopardized, as determined and approved by the program administrator.
15.6.2 The student’s physician must provide a written authorization for the teacher to administer the service. Such service shall be operable under the general supervision of a credentialed County Office school site administrators nurse. Such authorization shall include a description of how and when the service is to fully participate be performed.
15.6.3 Employees are required to follow these procedures and exercise the skill and care required by a reasonably prudent person when providing said services. No employee shall be required to provide such services which are beyond their training.
15.6.4 Employees following these procedures will be covered by the Shasta County Schools’ Office liability insurance policy.
15.7 At the request of the unit member, the County Office will reimburse unit members for their damaged property, limited to eye glasses, hearing aids, jewelry or clothing worn by the unit member, when such property is damaged in the expulsion processline of duty without the fault of the unit member. The limit of payment shall be $250.00.
15.8 The County Office will reimburse unit members for the loss, destruction, or damage by arson, burglary or vandalism of personal property, used in special education classrooms, or any department facility, including participating administrative offices. To be eligible for reimbursement under this section, the unit member must have received written authorization from their Supervisor to use such personal property in the initial investigation, providing a written statement performance of their employment. The value of the property is to be determined at the time permission for use is given.
15.9 Reimbursement provided pursuant to Section 15.7 and 15.8 shall only be provided as limited by those sections and after the employee has submitted a claim to his/her personal insurance carrier. Reimbursement by the County Office is intended to augment, not replace, personal insurance coverage. In no event is the County Office reimbursement, when added to personal insurance compensation, to exceed the total value of the incidentproperty being replaced or repaired. Reimbursement will be based on the value declared in accordance with Section 15.8.

Members of the Bargaining Unit shall not be required to work under conditions or to perform tasks which endanger their health, safety or well-being as determined by the appropriate Federal, State or local public agency.
22.2 It is the intent of the parties to provide an expedited process for reporting and resolving facilities/equipment safety issues. Members of the Bargaining Unit shall submit a student's teacher, the District may exclude from a class any student who, in the teacher's opinion, has filthy or vicious habits; or suffers from a contagious or infectious disease; or suffers from a physical or mental disability which would cause work order to his/her attendance immediate supervisor or designee to be inimical to the welfare of other students; report any unsafe, hazardous, or acts in potentially dangerous working condition(s). Oral notice is acceptable for extreme threats such as a way that the teacher believes good cause exists for such student's exclusion. The District shall notify the teacher of its decision within a reasonable period of time, and, upon request, provide the teacher reasons in writing should it not follow the teacher's recommendationsgas leak or downed electrical lines.
13.2 Teachers may suspend, for good cause, any pupil from the class for not exceeding one school day, plus the remainder of the school day during which the suspension is ordered, if suspension is ordered during a school day, and shall immediately report the suspension 22.3 Response to the principal of the school and send the pupil to the principal for appropriate action. Good cause includes, but is not limited to, the offenses enumerated in Education Code Section 48900.
13.3 The rights and duties of teachers with respect to student discipline, including use of corporal punishment and the exclusion and suspension of students under the Education Code, shall be communicated to teachers during the orientation week at the beginning of the school year. Upon request, the copy of the Education Code provisions relating to student suspension and exclusion facilities/equipment safety issues shall be made available to teachers at each school site.
13.4 When, in the judgment of the teacher, a student requires attention of the counselor, psychologist, nurse, or District specialist, he/she shall so inform the principal. The principal shall arrange as soon as reasonably possible for a conference between based upon the teacher and an appropriate District-employed specialist level of threat. Reports of failure of the responsible person to discuss promptly investigate and/or resolve the problem and appropriate steps for its resolutionissue(s) shall be made to the Assistant Superintendent of Human Resources.
13.5 Teachers may use reasonable lawful force under the circumstances in order to defend themselves or others against an 22.4 Any abuse of school personnel, assault or battery upon school personnel, or any threat of force or violence directed toward school personnel at any time or place which occurs within the scope of employment.
13.6 Cases of assault suffered by teachers in connection with their employment is related to school activity or school attendance shall be reported immediately by Members of the Bargaining Unit to their principalimmediate supervisor. ThereafterUpon receipt of such a report from a Member of the Bargaining Unit, both the teacher employee and the principal his/her immediate supervisor shall immediately report the incident to the police. SAFETY CONDITIONS OF EMPLOYMENT. 13.1 Upon A. The District assumes the recommendation responsibility for the safety of a studentemployees while they are present in District facilities performing assigned duties as long as the procedures of this Article have been followed by the affected employee. An employee shall not be required to work in unsafe or unhealthy conditions as long as the procedures of this Article have been followed by the affected employee.
B. The District shall prepare, publish, and post rules for safety and the prevention of accidents, provide protective devices where they are required for the safety of employees, and provide suitable and safe equipment where such equipment is required for the conduct of the District's teacher, educational program and the District may exclude from a class any student who, in operation of the teacher's opinion, has filthy or vicious habits; or suffers from a contagious or infectious disease; or suffers from a physical or mental disability which would cause his/her attendance to be inimical to the welfare of other students; or acts in such a way that the teacher believes good cause exists for such student's exclusionschools.
1. The District shall notify be responsible for the teacher promulgation of its decision within a reasonable period of time, and, upon request, provide the teacher reasons District safety rules.
2. Employees shall be responsible for observing all safety rules and standards and shall promptly report in writing should any alleged unsafe or unhealthy conditions found in District facilities.
3. The District agrees to investigate all allegations of unsafe conditions and will implement corrective measures it not follow deems appropriate to resolve demonstrated safety hazards.
C. Employees shall immediately report cases of assault suffered by them during the performance of assigned duties to their building principal or other immediate supervisor, who shall immediately report the incident to the proper law enforcement agency, when appropriate, and forward such notification to the Superintendent.
D. When a teacher suspends a student from the teacher's recommendationsclass pursuant to Education Code Section 48910, the procedures required by the Education Code and Board Policy (including the applicable Administrative Regulations) shall be followed.
13.2 Teachers 1. Education Code section 48910 states:
(a) A teacher may suspend, for good cause, suspend any pupil from the class teacher’s class, for not exceeding one school day, plus the remainder any of the school acts enumerated in Section 48900, for the day during which of the suspension is ordered, if suspension is ordered during a school day, and the day following. The teacher shall immediately report the suspension to the principal of the school and send the pupil to the principal or the principal's designee for appropriate action. Good cause includes, but is not limited toIf that action requires the continued presence of the pupil at the school site, the offenses pupil shall be under appropriate supervision, as defined in policies and related regulations adopted by the governing board of the school district. The pupil shall not be returned to the class from which he or she was suspended, during the period of the suspension, without the concurrence of the teacher of the class and the principal.”
(b) A pupil suspended from a class shall not be placed in another regular class during the period of suspension. However, if the pupil is assigned to more than one class per day, this subdivision shall apply only to other regular classes scheduled at the same time as the class from which the pupil was suspended.”
(c) A teacher may also refer a pupil, for any of the acts enumerated in Education Code Section 48900, to the principal or the principal's designee for consideration of a suspension from the school.”
