Sales Effort. Ligand agrees to use commercially reasonable selling efforts to, and otherwise promote, the Products, and not to:
(a) Refuse or fail to supply promptly the Products when specified;
(b) Fail to include in its system for determining its prices to its customers any provisions necessary to comply with the other provisions of this Agreement or enter into any agreement which would preclude Ligand from offering for sale a Product at any price acceptable to Ligand; or
(c) Sell any Products to any party Ligand has reason to believe plans to use the Products or sell the Products for use outside the Territory. Ligand agrees that it shall hire and maintain a sales force appropriate for marketing of the Products in the Territory, develop and implement appropriate marketing plans, develop and utilize sales literature and other promotional aids, hold symposia for key physicians, and otherwise perform the duties associated with a promoter of the Products in the Territory.
Sales Effort. 7.1 The Sales Representative shall use its best efforts to promote the sale and use of, and to secure orders for PT products within the Territory and Market, so as to create the largest volume of profitable business for PT commensurate with the opportunities therefor. The Sales Representative shall promote the goodwill and name of PT, and do everything within its capabilities to further the interest of PT, its name and PT products including participation in trade shows, seminar programs and all sales activities undertaken by PT. It shall endeavor to provide PT with timely feedback on all major tenders. It shall assist PT in furnishing or obtaining, on request, information as to credit standing of purchasers or prospective purchasers of PT products.
7.2 The Sales Representative shall faithfully observe and comply with PT standard policies and procedures where applicable, when soliciting orders for PT products or otherwise handling PT business under this Agreement.
Sales Effort. Inverness shall use commercially reasonable efforts to launch, promote, develop a demand for the HIV Barrel Product, and to Exploit the HIV Barrel Products to the markets for which regulatory approvals have been obtained throughout the applicable territory and perform such responsibilities diligently, with the objective of maximizing the sales potential of those products and promoting the benefits thereof in the most commercially beneficial manner.
Sales Effort. Each Party undertakes with the other Party to promote on a non-exclusive basis the sale of the agreed upon telecommunications services.

Sales Effort. Salesperson agrees to act as an independent real estate salesperson and shall faithfully, loyally and legally engage his/her efforts to sell, trade, lease or rent any and all real estate listed with Broker, to solicit additional listings, customers and clients for Broker, and to otherwise promote the business of serving the public in real estate transactions to the end that each of the parties hereto may derive the greatest profit possible.
Sales Effort. To promote the Products, to give them full selling efforts and full distribution services, and not to;
1. Refuse or fail to supply promptly the Products when specified, or
2. Fail to include in its system for determining its prices to its customers all Lilly special net wholesale prices or enter into any agreement which would preclude the Wholesaler from offering for sale a Product at any price acceptable to the Wholesaler.
3. Sell any Product to any party who the Wholesaler has reason to believe plans to use the Product or sell the Product for use outside the geographic boundaries of the United States, the District of Columbia, the Commonwealth of Puerto Rico or the territories of the United States.
Sales Effort. Abaxis shall use a degree of effort to market, promote and Sell the Products in the Field in the Territory [ * ].
Sales Effort. The Company agrees to make reasonable efforts to sell merchandise bearing The Image. If, despite reasonable efforts on the part of the Company, merchandise bearing The Image does not sell, The Company may temporari- ly or permanently halt efforts to sell merchandise bearing The Image.

Tularik and JT shall each diligently perform its respective obligations under the Marketing Plan and use efforts to Co-Promote Products in the Co-Promotion Territory pursuant to the terms and conditions hereof from initiation of pre-launch activities for such Product in the Co-Promotion Territory until the expiration of the Term comparable to those it uses to promote other products of similar commercial value.
