MARKETING EFFORT. Xxxxxx and SuperGen shall use their reasonable efforts to Co-Promote the Product in the U.S. Territory, and Xxxxxx shall use its reasonable efforts to Promote the Product in the International Territory, to maximize Product Sales in the Territories. Xxxxxx shall use its reasonable efforts to implement, and shall make tactical decisions with regard to, Promotion in the International Territory, consistent with the terms of this Agreement.

MARKETING EFFORT. A. Roles (I) During the course of this Agreement, the Parties shall be responsible for and reasonably cooperate in planning and executing the Business Initiatives. Both Parties shall share marketing intelligence and shall identify specific opportunities and determine appropriate strategies to acquire contracts for the Business Initiatives under this Agreement. (II) Parties shall use their best efforts to secure prime contracts for the Business Initiatives and Parties shall support and assist each other in securing subcontracts for the defined Business Initiatives. B. Marketing Expenses Each Party shall be solely responsible for their own marketing expenses. Both Parties will make their best efforts to have personnel available for presentations, meetings, site visits, and other activities pursuant to the Business Initiatives.
MARKETING EFFORT. Abbott and Triangle shall use their Reasonable Best Efforts to Co-Promote the Products in the Territory. The Co-Promotion Date for Norvir shall be within *** from the date that Triangle notifies Abbott that it intends to begin Co-Promoting Norvir; provided, however, in no event shall the Co-Promotion Date be later than *** . The Co-Promotion Date for ABT-378 shall be *** provided that the Condition has been satisfied by such date. If the Condition is satisfied after *** ABT-378, the Co-Promotion Date shall be within *** after the Condition has been satisfied. Abbott shall be the lead Party for implementation of, and shall make tactical decisions with regard to, Co-Promotion of the Products in the Territory.
MARKETING EFFORT. 5.1 The Contractor will make every effort to market the Line(s) in order to make Services profitable and to maintain good business and working relationships with local businesses, State and local government officials, employees, and other railroads, and will report on the marketing effort on a form and according to a schedule to be specified by the State. (See EXHIBIT A)

Xxxxxx shall use its Reasonable Best Efforts to implement, and shall make tactical decisions with regard to, Promotion in the International Territory, consistent with the terms of this Agreement, the then current International Promotion Plan and International Promotional Materials and any applicable direction provided by the International Marketing Board.
MARKETING EFFORT. Licensee agrees to exert its best reasonable efforts, consistent with the profit opportunity relative to other products in Licensee's pipeline and market conditions in the Territory to introduce and diligently promote, sell and service the Licensed Product within the Territory, including, without limitation, the full and complete attainment of the Minimum Sales Requirements as set forth below in Section 3.7.
MARKETING EFFORT. Personics agrees that it will use its best good faith efforts to market DTS through sales and/or licenses. Personics and Huger shall cooperate to permit Personics to commence marketing. Personics makes no representations or warranty that DTS will be successfully marketed or that any minimum level of sales or licensing will be achieved except to the extent that Personics must meet certain minimum performance obligations as described in Paragraph 2(c) in order to retain exclusivity. 4 <PAGE> (b)

MARKETING EFFORT. NationsRx shall supply Associate with reasonable amounts of Product literature. Associate shall provide Registered Qualified Prospects with Product literature provided by NationsRx or its affiliates only. Any and all advertising, promotional material or other materials developed by the Associate is subject to the prior written approval by NationsRx before distribution to any third parties. Both NationsRx and the Associate shall have the right but not an obligation to disclose the relationship between the parties to End-User's.
MARKETING EFFORT. Accentia will provide the marketing services for the FDA Products as set forth in Schedule 1 attached hereto (the “Marketing Services”). Any breach by Accentia of its obligations to provide the Marketing Services shall be deemed a material breach of this Agreement and cause for PPD to exercise the provisions of Paragraph 8(c). At PPD’s request, Accentia shall make available to PPD Accentia’s management personnel with direct responsibility for Product development, commercialization and marketing, for meetings and teleconferences. Such meetings and teleconferences will be during business hours and PPD shall provide reasonable advance notice of its request for such meetings and teleconferences. The sole purpose of the meetings and teleconferences will be to provide PPD with information relating to Accentia’s performance of its obligations under this Agreement.
MARKETING EFFORT. The Distributor shall use its commercially reasonable efforts to promote the Products to persons engaged in all appropriate medical specialties, including but not limited to plastic surgery, dermatology, ENT (ear, nose, and throat), aesthetic and cosmetic medicine and other related areas of the medical profession.
