Section 12.9. It is understood and agreed that employees can exercise their seniority rights under the Layoff Article; however, if they exercise such seniority rights, the provisions of this Article shall be null, void and not applicable. Employees may exercise their seniority rights to bump the least senior employee in their classification in the bargaining unit closest to their home, provided all stores in the affected bargaining unit have closed; however, if they exercise such seniority rights, the provisions of this Article shall be null, void and not applicable.

Section 12.9. 2 All bumps instituted in Section 12.8 shall be effective no later than the sixth working day after written 3 notice is provided. Employees who are bumped shall be entitled to claim the route vacated by the 4 bumping employee, or to institute a bump subject to the limitations of Section 12.8.
Section 12.9. The Company and Union agree that the Employer is responsible for maintaining a sound safety program and its employees are responsible for adhering to the safety program by working safely, being continually alert so they may prevent injury to themselves, fellow employees, and our customers. Employees are responsible for reporting any safety hazards immediately to store management so that they may be addressed in accord with the Company safety program.
Section 12.9. 22 In the event of layoff, employees so affected are to be placed on a reemployment list maintained by the 23 District according to layoff ranking. Such employees are to have priority by seniority over applicants 24 from outside the district in filling an opening in the classification held immediately prior to layoff.
Section 12.9. 14 Employees on layoff status shall file their addresses in writing with the personnel office of the District 15 and shall thereafter promptly advise the District in writing of any change of address.

Section 12.9. No benefits shall accrue under the terms of this Article unless the Employer makes a business decision to close or sell a store. If a store closing is caused by fire, flood, storm, land condemnation or remodeling then this Article shall not apply.
