Security Event. If a party learns or has reason to believe that the other party’s Confidential Information has been disclosed or accessed by an unauthorized party (each, a “Security Event”), such party will immediately give notice of such event to the other party to the extent permitted by law or law enforcement authorities. In such notification, the party will report on the nature of the incident, the estimated impact on the other and investigative action taken or planned. Security Events shall include, without limitation, violations of Applicable Law. Notwithstanding anything in this provision, each party will also comply fully with all federal, state or local laws applicable to security breaches. Except as may be required by law or law enforcement authorities, to the extent the breach involves Client Portfolio Information, PFSC will not notify any of Client’s customers or potential customers of unauthorized access of such Security Event without Client’s express consent or upon Client’s specific instruction. The party that experiences the Security Event will be responsible for the costs of any required notifications.

In the event that Subscriber or a Permitted User learns or has reason to believe that any NMLS data, including Public Use Information accessed through NMLS B2B ACCESS℠, has been disclosed or accessed by an unauthorized party as a result of an act or omission of Subscriber or a Permitted User, including by Subscriber’s employees, directors, officers, agents, representatives, independent contractors or any third party engaged by Subscriber (a “Security Event”), Subscriber shall immediately notify SRR and investigate. ii. In the event of a Security Event that potentially involves individually identifiable information (e.g., social security numbers, driver’s license numbers or dates of birth), Subscriber shall: I. Notify SRR immediately, II. After consultation with SRR, notify the individuals whose information was disclosed that a Security Event has occurred, and III. Be responsible for any other legal obligations, up to $5 million ($5,000,000.00) per Security Event, that may arise under applicable law in connection with such a Security Event.

In the event of a Security Event potentially involving non-public personally identifiable information (“PII”, e.g., social security numbers, driver’s license numbers or dates of birth) that may have been combined with or associated with Public Use Information accessed or used by Subscriber through the Service, Subscriber shall: a) Notify SRR immediately, b) Coordinate notification to appropriate State or Federal agency(ies) with SRR, c) After consultation and in coordination with SRR, notify the individuals whose information was disclosed that a Security Event has occurred, and Be responsible for any other legal obligations arising under applicable law in connection with such a Security Event.
Security Event. If Backup Servicer learns or has reason to believe that PFL's Confidential Information has been disclosed or accessed by an unauthorized party (each, a "Security Event"), Backup Servicer will immediately give notice of such event to PFL to the extent permitted by law or law enforcement authorities. In such notification, Backup Servicer will report on the nature of the incident, the estimated impact on PFL and investigative action taken or planned. Security Events shall include, without limitation, violations of Applicable Law. Notwithstanding anything in this provision, Backup Servicer will also comply fully with all Applicable Law applicable to security breaches. Except as may be required by law or law enforcement authorities, to the extent the breach involves "non-public personal information ", Backup Servicer will not notify any of PFL's customers or potential customers of unauthorized access of such Security Event without PFL's express consent or upon PFL's specific instruction. Backup Servicer will be responsible for the costs of any required notifications. (c)
Security EventClient agrees and undertakes that Authorised Third Party shall acknowledge that, upon unauthorized acquisition or access of or to Personal Data while in Authorised Third Party’s possession or under its control, including but not limited to that which is due to use by an unauthorized person or due to unauthorized use (a "Security Event"), Authorised Third Party shall, in compliance with applicable Data Protection Laws, notify the Data Controller that a Security Event has occurred, and shall also notify the Service Provider. Client agrees and undertakes that Authorised Third Party shall agree that such notification shall not reference Service Provider or the product through which the Personal Data was provided, nor shall Service Provider be otherwise identified or referenced in connection with the Security Event, without Service Provider’s express written consent. Client shall be solely responsible for any other legal or regulatory obligations which may arise under applicable law in connection with such a Security Event and shall bear all costs associated with complying with legal and regulatory obligations in connection therewith. Client agrees and undertakes that Authorised Third Party shall remain solely liable for claims that may arise from a Security Event, including, but not limited to, costs for litigation (including attorneys’ fees), and reimbursement sought by individuals, including but not limited to, costs for credit monitoring or allegations of loss in connection with the Security Event, and to the extent that any claims are brought against Service Provider, shall indemnify Service Provider from such claims. In the event of a Security Event, Service Provider may, in its sole discretion, take immediate action, including suspension or termination of Authorised Third Party’s account, without further obligation or liability of any kind.
Security EventIn the event that Customer learns or has reason to believe that ChoicePoint data has been disclosed or accessed by an unauthorized party, Customer will immediately give notice of such event to ChoicePoint. Furthermore, in the event that Customer has access to or acquires individually identifiable information (e.g., social security numbers, driver’s license numbers or dates of birth) in relation to the Agreement, the following shall apply: Customer acknowledges that upon unauthorized acquisition of such individually identifiable information (a "Security Event"), Customer shall, in compliance with law, notify the individuals whose information was disclosed that a Security Event has occurred. Also, Customer shall be responsible for any other legal obligations which may arise under applicable law in connection with such a Security Event.
