SENIORITY AND REDUCTION IN FORCE. 9.01 An employee’s seniority date shall be the date of hire in the Port. The probationary period for any employee appointed to a classification under this Agreement shall be for the twelve (12) calendar months following such appointment. The probationary period may be extended at the discretion of the Chief of Police (hereinafter referred to as the Chief) if the probationary employee has been absent due to bona fide illness or other legitimate reason. If an employee, who has promoted to the bargaining unit from a Police Communication Specialist or a Police Specialist position, fails to pass the probationary period, the employee shall be allowed to return to his/her former position provided there is an opening available. An employee returning to a former position under these circumstances shall resume their seniority within the former bargaining unit as if continuously employed there. 9.02 Seniority shall prevail in the event of a layoff; thus, the last employee hired in a classification shall be the first laid off. Employees laid off in accordance with the provisions of this Article will be eligible for rehire in the inverse order of layoff for a period of one (1) year following layoff. Employees who are separated from employment before the completion of their probationary period shall not be subject to recall rights as outlined in this Article. 9.03 In the event of an imminent reduction in force, written notice shall be provided to each employee scheduled for layoff at least fourteen (14) days prior to termination. 9.04 Vacation scheduling shall be done so that seniority is the primary consideration. c. An employee who has been subject to a reduction in accordance with the provisions of this Article will force due to automation shall not suffer a break in seniority and may be eligible for rehire in recall for up to two (2) years from the inverse order date of layoff for a period of one (1) year following the layoff. Employees who are separated from employment before the completion of their probationary period shall not be subject to recall rights as outlined All employees in this Article.

SENIORITY AND REDUCTION IN FORCE. 9.01 An employee’s 1. A seniority date list, by classification group, as reflected in the attached salary schedule by the following titles: head xxxx/supervisor; kitchen assistant; custodian; maintenance/supervisor; bus driver; Ed. Tech I, II and III; school secretaries and library associate, shall be established naming all the date employees covered by this Agreement with the employee with the greatest seniority (years of hire service) listed first. Seniority for the purpose of this agreement shall be a major factor in all matters affecting layoff, recall, job assignments, and shift assignments.
2. All new employees shall serve a probationary period as set forth in Article 4 starting with his/her first day of employment and will be added to the seniority list at the end of said probationary period.
3. If it becomes necessary for the Board to layoff employees for any reason, employees shall be laid off in inverse order of their seniority by classification group, as reflected in the Portattached salary schedule, provided the remaining employees meet the qualifications to perform the remaining work. All affected employees shall receive a two (2) calendar week advance notice of layoff, and the Superintendent shall meet with the affected employees prior to the actual occurrence of layoff. Employees shall be recalled from layoff to their previous position according to their seniority, provided the employee is qualified to perform the work. The probationary employee shall keep the Superintendent’s Office up-to-date as regards address changes. Once notified, a recalled employee shall provide the Superintendent written acceptance within five (5) days. The employee waives the right to recall if he/she refuses a position. No new employees shall be hired until all employees on layoff status have been afforded recall notice. The recall period for any employee appointed to a classification under this Agreement shall be for the twelve (12) calendar months following such appointmentfrom the effective date of layoff.
4.
