Service Establishment. 11.2.1.1 CLEC shall pay a Direct Access Service Establishment Charge (a non-recurring charge) applied at the time a CLEC orders Direct Access.
Service Establishment. Per Route, Per Switch. This non-recurring cost is incurred for each INP Provider’s end office switch that is equipped to provide INP to the INP Requestor.
Service Establishment. Service establishment charges apply to recover the establishment costs for electronic interfaces and other operational support systems (OSS).
(A) RECURRING ESTABLISHMENT CHARGES A recurring monthly charge per reseller will be assessed during the five (5) year recovery period. This charge provides for NYNEX region-wide access to the OSS platform.
(B) NON-RECURRING ESTABLISHMENT CHARGES A Non-Recurring charge per OSS Transaction will be assessed during the seven (7) year recovery period for developmental costs (includes development and ongoing costs).
Service Establishment. The Affiliate agrees to pay to CUE a fee of $**** each time Affiliate activates a pager.
Service Establishment. 7.1. As soon as reasonably practicable after KT’s acceptance of the Order Form, Service Establishment will commence. KT will advise Customer of the estimated time for the completion of Service Establishment. KT will notify Customer.
7.2. If End Users need to be migrated from an alternative supplier’s service onto the Calls Service, the parties will agree a migration plan where applicable to move them onto the Call Service.
7.3. If KT is required to incur any costs not reasonably contemplated in any migration off the Calls Service, the KT reserves right to charge for its services at a reasonable charge and Customer agrees to pay such amount.
7.4. The terms and conditions of this Agreement shall continue to operate during any period where end user CLIs remain on the Calls Service after termination including the payment of the Call Charges by Customer to KT.
7.5. Customer and KT agree that they do not intend for the commencement of all or any part of the Call Services to constitute a relevant transfer for the purposes of the TUPE Regulations.
7.6. Customer agrees to indemnify KT and keep KT indemnified against any Liabilities arising out of or in connection with any claim that or decision by a Court or Tribunal that the contract of employment of any staff of Customer or its contractors has transferred to KT under the TUPE Regulations or otherwise as a result of the parties entering into this Agreement, including (without limitation), any liability for failure to inform and consult under the TUPE Regulations.
7.7. If any contract of employment of any staff of the Customer or its contractors has effect (or is argued to have effect) as if originally made between KT and said staff as a result of the TUPE Regulations or otherwise at any time, then KT may, on becoming aware of that effect (or argued effect) terminate the contract of employment of that person and Customer agrees to indemnify KT against any Liabilities arising out of such termination and against any sum payable to or in respect of such person prior to termination of employment.
7.8. The indemnities in clauses 7.6 and 7.7 are not subject to the limitation of liability set out in clause 8.2.
