Shift give away and pick-ups. Notwithstanding the above, rostering arrangements may be changed at any lime by agreement between the Company and any two or more Employees where the Employees enter into a "shift give away" or "shift pick up" arrangement. In these circumstances, the Employee who picks up a shift will be paid (in the case of a Part-Time Employee) or receive time in lieu (for Full-Time Employees) for the hours actually worked at their Base Rate of Pay and no overtime or other penalties will be payable by the Company to the Employee/s. The application of these "shift give- away" and "shift pick-up" arrangements will be in accordance with the following principles: i. Full-Time and Part-Time Employees may pick up and give away up to 24 hours of work (net) per roster cycle. ii. Employees must ensure they do not enter into shift give- away or pick-up arrangements that result in them: A. Working more than 12 consecutive hours; or B. Working more than 8 consecutive days; or C. Having less than 8 hours break between the completion of a rostered shift and the commencement of their next rostered shift. iii. Full-Time Employees will receive time in lieu and Part-Time Employees who elect to pick-up shifts will be paid at Base Rate of Pay for the shifts, even where the number of hours per cycle exceeds 160 (or 152 after the Transition Date). In such cases, these additional hours will not incur or result in cycle overtime. iv. All leave accruals, other than long service leave, will be based on actual hours worked or paid (excluding overtime or penalties), even for work performed in excess of 160 hours per cycle. v. In pandemic-like circumstances that are outside of the Company’s control (e.g., a Government shutdown), the Company can change Employee rosters by giving Employees 72 hours’ notice.

  • Leave for Medical and Dental Care (a) Where it is not possible to schedule medical and/or dental appointments or appointments with a registered midwife outside regularly scheduled working hours, reasonable time off for such appointments for employees or for dependent children shall be permitted, but where any such absence exceeds two hours, the full-time absence shall be charged to the entitlement described in Clause 20.12. "Medical, dental and/or registered midwife appointments" include only those services covered by the BC Medical Services Plan, the Public Service Dental Plan, the Extended Health Benefit Plan and assessment appointments with the Employee and Family Assistance Program. (b) Employees in areas where adequate medical and dental facilities are not available shall be allowed to deduct from their credit described in Clause 20.12 the necessary time including travel and treatment time up to a maximum of three days to receive medical and dental care at the nearest medical centre for the employee, their spouse, dependent child and a dependent parent permanently residing in the employee's household or with whom the employee permanently resides. The Employer may request a certificate of a qualified medical or dental practitioner, as the case may be, stating that treatment could not be provided by facilities or services available at the employee's place of residence. An employee on leave provided by this clause shall be entitled to reimbursement of reasonable receipted expenses for accommodation and travel to a maximum of $510 effective April 1, 2019, $520 effective April 1, 2020, and $530 effective April 1, 2021 per calendar year. (c) An employee otherwise entitled to leave pursuant to (b) above who chooses to travel on a vacation day or a day of rest or to remain at work and not accompany their spouse, dependent child or dependent parent, as provided in (b) above, may claim the reimbursement of receipted expenses under the conditions stipulated. (d) Employees in receipt of STIIP benefits who would otherwise qualify for leave under this clause shall be eligible to claim expenses in the manner described above. (e) Where leave pursuant to (b) above would be reduced, the Employer may approve airfare payment for the employee in lieu of the $510 effective April 1, 2019, $520 effective April 1, 2020, and $530 effective April 1, 2021 reimbursement, once per calendar year. (f) For the purpose of this clause, "child" includes a child over the age of 18 residing in the employee's household who is permanently dependent on the employee due to mental or physical impairment.

Unless otherwise expressly agreed in writing by Xxxxxxxxxx, no one other than the Company is authorized to rely upon this Agreement or any other statements or conduct of Xxxxxxxxxx, and no one other than the Company is intended to be a beneficiary of this Agreement. The Company acknowledges that any recommendation or advice, written or oral, given by Xxxxxxxxxx to the Company in connection with Xxxxxxxxxx’x engagement is intended solely for the benefit and use of the Company’s management and directors in considering a possible Offering, and any such recommendation or advice is not on behalf of, and shall not confer any rights or remedies upon, any other person or be used or relied upon for any other purpose. Xxxxxxxxxx shall not have the authority to make any commitment binding on the Company. The Company, in its sole discretion, shall have the right to reject any investor introduced to it by Xxxxxxxxxx.
