Common use of Sick Leave During Leave of Absence and Layoff Clause in Contracts

Sick Leave During Leave of Absence and Layoff. When an employee is given paid vacation or special paid leave of absence, he/she shall receive on his/her return to work sick leave credit for the period of such absence. When an employee is laid off on account of lack of work for a period of time which is less than the period stipulated in the Clause 21.03 governing the retention of seniority on layoff and returns to work upon expiration of such layoff, he/she shall not receive sick leave credit for the period of such absence, but shall retain his/her accumulative credit, if any, existing at the time of such layoff.

Sick Leave During Leave of Absence and Layoff. (a) When an employee is given paid vacation or special paid leave of absence, he/she shall receive on his/her return to work sick leave credit for the period of such absence. When an employee is laid off absence on account of lack of work for a period of time which is less than the period stipulated in the Clause 21.03 governing the retention of seniority on layoff and returns to work upon expiration of such layoff, he/she shall not receive sick leave credit for the period of such absence, but shall retain his/her accumulative credit, if any, existing at the time of such layoffreturn to work.

When an employee is given paid vacation or special paid leave of absence, absence or while on Workers' Compensation he/she shall receive sick leave credits for the period of such absence on his/her return to work sick leave credit for the period of such absencework.
