Common use of Sick Leave During Leave of Absence and Layoff Clause in Contracts

Sick Leave During Leave of Absence and Layoff. When an employee is granted leave of absence without pay or receives layoff, and such absence exceeds thirty (30) days, the employee shall maintain but not accrue sick leave credits.

Sick Leave During Leave of Absence and Layoff. When an employee works at least ten (10) days in a month or is on paid leave, she shall receive sick leave credit for that calendar month. When an employee is granted laid off on account of lack of work, she shall not receive sick leave credits for the period of absence without pay or receives layoff, and such absence exceeds thirty (30) daysbut shall retain her cumulative credit, if any, existing at the employee shall maintain but not accrue sick leave creditstime of such layoff.

When an employee is granted given a leave of absence without pay for Workers Compensation or receives layoffwork related disability; maternity/ parental/ adoption leave; the employee shall receive sick leave credits for up to a three (3) year period of such absence, and such absence exceeds thirty (30) dayson the employee’s return to work. When an employee is laid off on account of lack of work, the employee shall maintain but not accrue receive sick leave creditscredits for the period of such absence but shall retain the employee’s cumulative credit, if any, existing at the time of the lay-off.

When an employee is granted laid off on account of lack of work he shall not receive sick leave credits for the period of absence without pay or receives layoff, and such absence exceeds thirty (30) daysbut shall retain his cumulative credit, if any, existing at the employee shall maintain but not accrue sick leave creditstime of such layoff.
