Common use of Sick Leave Reimbursement Clause in Contracts

Sick Leave Reimbursement. The Corporation is subrogated to the rights of an employee who has received Sick Leave or Long Term Disability benefits, against any third party liable to that employee for damages, and may bring an action against the third party in the employee’s name to recover the wages and/or benefits paid or payable by the Corporation. The employee shall not enter any agreement for payment of legal fees relating to the wage or benefit portion of a claim for damages without the prior written consent of the Director of Human Resources. Where a claim for damages is made to the courts, the employee or his or her representative shall request the presiding judge, or judge and jury, to specify the amount of any award plus interest which is attributable to recovery of wages and benefits. Upon reimbursement of the wages and/or benefits, the Corporation shall reimburse the Sick Leave and Long Term Disability Plans, the amount of money paid out of the Plans in proportion to the total amount of money the employee reimburses the Corporation for wage loss and/or benefits. This provision includes actions or claims made to ICBC.

This provision includes actions or claims made to ICBC.
