SPECIAL GRANT REQUIREMENTS. The Provisions found in the Contractual Provisions Attachment (Form DA-146a, Rev. 07- 19), which is attached hereto as Appendix A, are incorporated in this contract and made a part thereof.
SPECIAL GRANT REQUIREMENTS. 4.1 The Phase 2, Construction Phase, may be exercised subject to the Government’s determination that Phase 1 is complete and the planned Construction Phase has met all Federal, State and Local requirements, and is subject to availability of funds. The Phase 2, Construction Phase Option, if exercised, will be via formal bilateral amendment to the grant signed by the Government and the Recipient.

SPECIAL GRANT REQUIREMENTS. 4.1 An acknowledgment of FHWA support and a disclaimer must appear in any publication of any material, whether copyrighted or not, based on or developed under the Agreement, in the following terms: “This material is based upon work supported by the FHWA under Grant Agreement [P- #].” All materials must also contain the following: “Any opinions, findings, and conclusions or recommendations expressed in this publication are those of the Author(s) and do not necessarily reflect the view of the FHWA.” 4.2 The Recipient shall make available to the Government copies of all work developed in performance of this Grant Agreement, including but not limited to software and data. The Government and others acting on its behalf shall have unlimited rights to obtain, reproduce, publish, or otherwise use the data developed in the performance of this Agreement pursuant to 2 C.F.R. Part 200. 4.3 There are no other special grant requirements for this Project.
SPECIAL GRANT REQUIREMENTS. 4.1 This Agreement will be carried out in two Phases consisting of a Base Phase and one Option Phase. The Base Phase is for funding preliminary design and final design for the Project. The Option Phase is to allow funding for construction activities for the Project. The exercise of Option Phase is subject to the Government’s determination that the FHWA has approved PS&E for work to be carried out under the Option Phase and FHWA’s determination that the Recipients have met all applicable Federal, State, and Local requirements required prior to the start of construction. Further, the approval for the Option Phase is subject to availability of funds. Finally, the obligation of FY 2014 TIGER Funds for the Option Phase will require execution of a formal bilateral amendment to this Agreement. 4.2 Washington County, Oregon and the Oregon Department of Transportation, as the Recipients under the TIGER Discretionary Grants Program, agree to administer the FY 14 XXXXX Xxxxx for the Project in accordance with the conditions set forth in this Agreement. The Oregon Department of Transportation shall administer the TIGER Discretionary Grant obligated by this Agreement, administer the contract for the design and construction of the Project, and perform such other administrative and oversight duties with respect to the Grant and the Project as the Recipients shall agree upon between themselves. The Recipients are independently developing an Intergovernmental Agreement (IGA) that describes each Recipient’s role and responsibilities in greater detail. Said IGA shall be executed following execution of the Agreement. 4.3 The Recipients will collect the information for the Project Outcomes and Performance Measurement Reports, the Annual Budget Review and Program Plan, and the report on the final scope of work, schedule, and budget as required in Section 3 of this Agreement. The Recipients shall jointly compile the information and submit to the Government the Project Outcomes and Performance Measurement Reports, the Annual Budget Review and Program Plan, and the report on the final scope of work, schedule, and budget as required in Section 3 of this Agreement. 4.4 There are no other special grant requirements for this Project.

SPECIAL GRANT REQUIREMENTS a) Except as otherwise provided herein, the Grantee shall ensure the maintenance of Project property to the level of utility (including applicable FRA track safety standards) which exists when the Project improvements are placed in service (as set forth in the Statement of Work (Attachment 2) for a period of twenty (20) years from the date such Project property was placed in service. In the event the Grantee fails to maintain project property as required by this section for a period of time in excess of six (6) months, the Grantee will refund to the Government a pro- rata share of the Federal contribution, based upon the percentage of the twenty (20) year period remaining at the time of such original default. b) The Grantee acknowledges that the purpose of the Project is to benefit railroad transportation. In the event that all intercity passenger rail service making use of the Project property is discontinued (for any reason) at any time during a period of twenty (20) years from the date such Project property was placed in service, as set forth above, and if such intercity passenger rail service is not reintroduced during a one (1) year period following the date of such discontinuance, the Grantee shall refund to the Government, no later than eighteen (18) months following the date of such discontinuance, a pro-rata share of the Federal contribution, based upon the percentage of the twenty (20) year period remaining at the time of such discontinuance.
SPECIAL GRANT REQUIREMENTS. For projects funded with both Recovery Act funds and Federal transit assistance under title 49, United States Code, Chapter 53, in addition to the terms and conditions set forth herein, all relevant FTA program requirements shall apply to any grant award using Recovery Act funds. For projects funded exclusively with Recovery Act funds, in addition to the terms and conditions set forth herein, the following requirements shall apply to any grant award using Recovery Act funds.
