Specific Provisions Re Self-Executing Security Agreement. By the Student’s oral request and written request to purchase Consultant’s services on the date of 03/08/2017 described in aforementioned Covenant at p 2, “A,” to purchase Consultant’s services on an as needed basis concerning the Student’s current stated need for Consultant to prepare for filing State of Michigan DEPARTMENT OF TREASURY amended returns and a correct return for year 2015; and having been apprised by Consultant concerning the same; and by said request Student consents to the current filing fee of $540 for Contractor’s services; and Student agrees to pay Consultant twenty percent (20%) of Savings*. Savings* pertaining to the Student as an employee as defined in this document will be funds that otherwise would be withheld from Student’s paycheck in the form of Federal Income taxes, State Income taxes, FICA (Social Security), Medicare. Savings* pertaining to Student as self-employed/private contractor or an owner of a company will be defined as those funds that would otherwise be paid by Student in the form of Federal Income taxes, State Income taxes, FICA, Medicare, FUTA. Said twenty percent (20%) of Savings* will be due and payable on a quarterly basis for a period of two years at which time Student may exercise an option to continue/discontinue services. Thus, your agreed amount to pay Consultant in quarterly installments will reflect the actual amount yet to be determined. For example, if the total amount of funds in 12 months aka 1 year earned = $50K at 30% tax rate = $15K leaving $35K take home pay with the TEA2 Consultant Services fee of 20% applied to said $15K = $3K the same subtracted from $50K leaves a new yearly take home pay of $47K; said fee subject to any price fluctuations due to changing market conditions; payable by direct deposit, cash, or in the form of United States Postal Money Order at the option of Consultant, with said total amount remitted to Consultant in full with no deductions of any kind within twenty-one (21) days of date of Consultant’s invoice re said billing with a ten percent (10%) compounded daily interest rate on any amount not paid within said specified period of time allowed User to make full remuneration to Consultant for said services rendered.   • Certification of Funds; Budget and Fiscal Provisions; Termination in the Event of Non-Appropriation This Agreement is subject to the budget and fiscal provisions of the City’s Charter. Charges will accrue only after prior written authorization certified by the Controller, and the amount of City’s obligation hereunder shall not at any time exceed the amount certified for the purpose and period stated in such advance authorization. This Agreement will terminate without penalty, liability or expense of any kind to City at the end of any fiscal year if funds are not appropriated for the next succeeding fiscal year. At such time, Agent will authorize the filing of appropriate termination statements to terminate such Security Interests. No transfer or renewal, extension, assignment, or termination of this Agreement or of the Credit Agreement, any other Loan Document, or any other instrument or document executed and delivered by any Grantor to Agent nor any additional Advances or other loans made by any Lender to Borrower, nor the taking of further security, nor the retaking or re-delivery of the Collateral to Grantors, or any of them, by Agent, nor any other act of the Lender Group or the Bank Product Providers, or any of them, shall release any Grantor from any obligation, except a release or discharge executed in writing by Agent in accordance with the provisions of the Credit Agreement. Agent shall not by any act, delay, omission or otherwise, be deemed to have waived any of its rights or remedies hereunder, unless such waiver is in writing and signed by Agent and then only to the extent therein set forth. A waiver by Agent of any right or remedy on any occasion shall not be construed as a bar to the exercise of any such right or remedy which Agent would otherwise have had on any other occasion.
