Statement of Confidentiality. Each party shall treat as confidential all information obtained from the other during the negotiation of, or pursuant to, this Study and shall not divulge such information to any person (except to such other party’s own Investigators or approved affiliates who need to know the same) without participants prior written consent provided that this clause shall not extend to information which is already public knowledge or becomes so at a future date (otherwise than as a result of a breach of this clause) or which is trivial or obvious. If collected data will contain identifiers or be able to link participant responses to their identity, explain the extent to which subject records and data will be held confidential. Statement of Confidentiality. Staff, volunteers, and any other persons with access to the Homeless Management Information System (HMIS) are subject to certain guidelines regarding its use. HMIS contains a wide range of personal and private information on individuals and all such information must be treated carefully and professionally by all who access it.

Unauthorized inspection or disclosure of State returns or other confidential taxpayer data is a misdemeanor (Sections 19542 and 19542.1, Revenue and Taxation Code and 90005, Government Code). Unauthorized inspection or disclosure of confidential data that includes Federal returns and other data is a felony (Sections 7213(a) (1) and 7213A (a) (1) (B) Internal Revenue Code).
