STATUTORY AND PAID HOLIDAYS. 12.01 Thirteen (13) days will be regarded as statutory and paid holidays under this Agreement. 12.02 The said statutory and paid holidays shall be considered as commencing at 7:00 a. m. on the day of the holiday and ending at 7:00 a.m. on the day following the holiday. 12.03 Subject to Section 12.04, if an employee is not scheduled to work on a statutory or paid holiday because it is their regular day off they shall be paid eight (8) hours straight time in addition to their monthly salary payable for time worked. If an employee is scheduled to work and actually works on a statutory or paid holiday, they shall be paid time and one-half in addition to their monthly salary payable for time worked. If an employee is required to work on Christmas or New Year's Day, they shall receive an additional four (4) hours pay. 12.04 No employee shall be entitled to pay for the holiday if they are absent or did not work a full shift on the day immediately preceding or immediately following the statutory or paid holiday, if either of these days were days on which they should have reported for duty except in cases of leave with pay recognized under the collective agreement. 12.05 If an employee is scheduled to be off, and is required to work overtime on a statutory or paid holiday, they will be paid at time and one-half for the time worked, in addition to the eight hours straight time payable under 12.03. 12.06 Two times per year, an employee who works on a statutory or paid holiday, may elect to bank twelve (12) hours and receive the balance of the pay for the day, provided the employee has less than eighty-four (84) hours vacation accrued at the time, and will not have more than twenty-four (24) hours banked. The employee may arrange to take the time banked as lieu time within the next year, on mutual agreement with the supervisor, and provided the employer will incur no overtime expense.

STATUTORY AND PAID HOLIDAYS. 21.01 The following shall be recognized as statutory or paid holidays for fulltime employees:

21.03 In order to qualify for the statutory or paid holiday, the employee must work his/her scheduled regular day preceding and following the holiday unless on authorized leave of absence, has agreed to work on the statutory or paid holiday and reports for and performs the agreed upon work. Subject to the foregoing, an employee who is laid off will receive any declared holidays which occur within seven (137) days will be regarded as statutory and paid holidays under this Agreement.
12.02 The said statutory and paid holidays shall be considered as commencing at 7:00
a. m. on of the day of layoff.
21.04 An employee who works on a statutory holiday shall receive pay at the holiday overtime rate for hours between 12:00 am and ending at 7:00 a.m. 11:59 pm on the day following statutory holiday in addition to any applicable holiday pay unless such employee elects to take time off with pay in an amount equal to the overtime rate for hours worked.
21.05 There shall be no pyramiding of overtime on a statutory or paid holiday.
12.03 Subject to Section 12.0421.06 An employee, if an employee is other than a rotational guard, who does not scheduled to work on a statutory or paid holiday because it is and who has met the qualifying conditions, will receive their regular day off they shall wages, which will be paid calculated on the basis of an eight (8) hours straight time hour day. A rotational guard, in addition to this instance, will receive their monthly salary payable for time workedregular wages, which will be calculated on the basis of a 10.8 hour day, with the exception of the rotational day guard position, which will be calculated on the basis of an 8 hour day. If an employee is scheduled to work and actually works on the rotational schedule changes from the schedule currently in use as of the date of signing, the calculation of the amount paid for the holiday for rotational guards will be revised in consultation with the union.
21.07 If a statutory or paid holiday, they shall be paid time and one-half in addition to their monthly salary payable for time worked. If an employee is required to work on Christmas or New Year's Day, they shall receive an additional four (4) hours pay.
12.04 No employee shall be entitled to pay for the holiday if they are absent or did not work falls within a full shift on the day immediately preceding or immediately following the statutory or paid holiday, if either of these days were days on which they should have reported for duty except in cases fulltime employee’s period of leave with pay recognized under pay, the

12.06 Two times per year, an employee who works on a statutory or paid holiday, may elect to bank twelve (12) hours and receive the balance of the pay for the day, provided owed. When the employee has less than eighty-four (84) hours vacation accrued at no such days owing him/her, then the time, and will not have more than twenty-four (24) hours bankedday off may be without pay. Part time employees shall be paid statutory holiday pay for statutory ESA holidays in accordance with the holiday if they are absent or did not work a full shift on the day immediately preceding or immediately following the statutory or paid holidayEmployment Standards Act, if either 2000 of these days were days on which they should have reported for duty except in cases of leave with pay recognized under the collective agreementOntario, as amended from time to time.

12.06 Two times per yearemployees who have completed their first (1st) year of full-time continuous service, an employee who works on a statutory or paid holiday, may elect to bank twelve (12) hours and receive the balance of the pay for the day, provided the employee has but less than eighty-four three (843) hours vacation accrued at the time, years of service shall receive one (1) float day per calendar year. Employees with three (3) years’ service but less than five (5) years of service shall receive two (2) float days and will not have Employee’s with five (5) or more than twenty-four (24) hours banked.
