Stowage. Item Stowage requirements
Stowage. The Vessel Party shall be solely responsible for the stowage of the Cargo. Cargo shall be stowed within the Vessel only in areas where equipment can reach, subject to Vessel design capability.

Dozer work shall be provided to the Vessel Party at an additional charge agreed upon by the Terminal and Vessel Party prior to the Vessel coming into Berth. In any event, the loading sequence plan shall not exceed two (2) pass loadings and two (2) hold trims. United Bulk Terminal will allow each Vessel two (2) draft checks which are not to exceed a period of 30 minutes each. Any Vessel exceeding the allotted time for draft checks will also be assessed the detention fee of $5,000 per hour. Any Vessel which is required to shift/warp within the berth will be responsible for any/all expenses pertaining to shifting/warping including, but not limited to, line handling, pilot, tug(s).
Stowage. (a) Subject always to the Vessel remaining seaworthy during loading and in anticipation of the intended voyage, a Vessel shall be determined to be fully loaded when in the Master’s opinion, the holds, after being trimmed, have been filled to the maximum level that will allow the hatches to properly close and fasten. If Buyer or Seller disputes that the Vessel was fully loaded, a competent surveyor shall be appointed by mutual agreement of the Parties to determine whether the Vessel was fully loaded. The surveyor’s findings shall be made available to both Parties and shall be final and binding on the Parties except in the case of fraud or manifest error. The prevailing Party shall be liable for the surveyor’s fee and any other costs of the survey, including any demurrage charges or reduction in despatch resulting from the conduct of such survey.
Stowage. During times that any part of the Nominated Network is not available, stowage will be provided for the Operator Rollingstock at mutually agreed location(s), taking into consideration the Operator maintenance requirements, depot locations and crew accessibility (i.e. walkways).

Stowage. Each immersion suit or anti-exposure suit must be stowed so they are readily accessible. The stowage positions must be marked with either the words “ IMMERSION SUITS” or “ANTI-EXPOSURE SUITS” as appropriate, or with the appropriate symbol from IMO Resolution A.760(18).

Goods stowed in any specially heated, cooled, or ventilated compartments are carried at the sole risk of the Merchant and the Goods. Carrier shall not be liable for any loss or damage occasioned by fluctuation in temperature, refrigeration, defects, insufficiency, explosions, breakdowns, derangement or failure of any refrigeration plant or part thereof, or any material used in the process of refrigeration unless such loss or damage is proven to have been caused by the negligence of the Carrier for which the Carrier is not by law entitled to exemption.
