Student Default. ON A FEDERAL OR STATE LOAN, both of the following may occur:
1. The federal or state government or a loan guarantee agency may take action against the Student, including garnishing an income tax refund, and
2. The Student may not be eligible for any other government financial assistance at another institution until the loan is repaid.
Student Default. Each of the following shall be a default by the Student:
Student Default. A maximum of one Term’s tuition fees and two Term’s Boarding fees will be incurred where a student’s enrolment is cancelled for any of the following reasons: • failure to maintain satisfactory course progress (visa condition 8202) • failure to maintain satisfactory attendance (visa condition 8202) • failure to maintain approved welfare and accommodation arrangements (Visa condition 8532) • failure to pay course fees • any behaviour identified as resulting in enrolment cancellation in MLC’s Student Code of Behaviour and Discipline Policy. Any unspent pro-rata fees will be refunded within three months.
Student Default. An international student or intending overseas student defaults, in relation to a course at a location, if:
(a) the course starts at the location on the agreed starting day, but the student does not start the course on that day (and has not previously withdrawn);
(b) the student cancels their enrolment in a course (either before or after the agreed starting day);
(c) the College refuses to provide, or continue providing, the course to the student at the location because of one or more of the following events:
(i) the student failed to pay an amount they were liable to pay the College, directly or indirectly, in order to undertake the course;
(ii) the student breached a condition of his or her visa;
(iii) misconduct by the student (Refer to the Student Code of Conduct and the Student Discipline Polices).
Student Default. A prospective and/or enrolled international student defaults where:
2.1.1 the student does not commence the program on the agreed start date and has not previously withdrawn.
2.1.2 the student withdraws from the program either a prior to the agreed start date b after the agreed start date
2.1.3 Xxxxxxx Xxxxxx Institute refuses to provide, or continue providing the program due to one or more of the following a student failed to pay an amount payable to the provider for the program b student breached a condition of their student visa c misbehaviour by the student

In your discussion with the replacement provider(s), you will need to talk about the suitability of the provider and the course. You will also need to take your academic transcript along with you. Pacific Flight Services will have arrangements in place through the Tuition Protection Scheme (TPS). Pacific Flight Services recognizes all AQF Qualifications and Statements of Attainment issued by other Registered Training Organisations (RTOs) and grants academic credit for such courses/units of study upon a prospective or existing student’s application (supported by the requisite documentary evidence) for such course credit. If you have previously completed qualification(s) or unit(s) of competency you may be eligible to apply for a course credit. Please visit Pacific Flight Services website and fill out the Credit Transfer Form, attach copies of the evidence you have (e.g., Certificate and/or Statement of Attainment) and submit all the evidence with your application. Applicants will be notified of the outcome of their application within 28 working days of its submission. Pacific Flight Services will assess whether the intending learners’ educational qualifications or work experience is sufficient to enable them to enter the course. If you are applying for Recognition, please complete and attach the Recognition Kit available from xxx.xxxxxxxxxxxxx.xxx.xx Course credit is available for units of competency offered by the Registered Training Organisation and listed on xxxxxxxx.xxx.xx. Credit transfer applies to situations where learners have completed at another Registered Training Organisation a unit of competency identical to those, they are currently enrolled in. An application for course credit can be made on Credit Transfer Form available from xxx.xxxxxxxxxxxxx.xxx.xx
Student Default. The student makes a material statement that is proven to be false or provides a fraudulent document or the student is guilty of misconduct leading to expulsion or cancellation of enrolment. No refund for the current teaching period. Any fees paid in advance for future teaching periods will be refunded in full.
Student Default. The student withdraws from the Institution on or prior to the first day of the new teaching period they are enrolled in A full refund less administrative expenses of $1000. Where fees for the new teaching period have not been pre- paid, a cancellation fee of $1000 applies
Student Default. Under the ESOS Act, an overseas student or intending overseas student defaults, in relation to a course at a location, if: • the course starts at the location on the agreed starting day, but the student does not start the course on that day (and has not previously withdrawn); or • the student withdraws from the course at the location (either before or after the agreed starting day); or • the registered provider of the course refuses to provide, or continue providing, the course to the student at the location because of one or more of the following: o the student failed to pay any amount payable to the provider for the course; o the student breached a condition of his/her student visa; o misbehaviour by the student Please note that a student does not default for failing to start a course on the agreed starting day if he/she does not start the course because the provider defaults in relation to the course at the location. Pivotal Education has arrangements in place through the Tuition Protection Scheme (TPS) should the institute defaults the course due to the following events:
Student Default. If a student cancels their enrolment before the commencement date: • Ten weeks or more prior to course commencement – refund of 100% of all tuition and equipment fees* • Six weeks up to ten weeks prior to course commencement – refund of 85% of all tuition and equipment fees* • Four weeks up to six weeks prior to course commencement – refund of 75% of all tuition and equipment fees* • Less than four weeks prior to course commencement – refund of 50% of all tuition and equipment fees* If the student defaults after the commencement date, no refund will be issued to the student.
3.02 The Education Services Overseas Students Act (ESOS)
3.02.1 Under the ESOS Act the above contract does not remove the right to take further action under Australia’s consumer protection laws.
3.02.2 The ESOS Act ensures student rights to pursue other legal options.
3.02.3 Under the provisions of the Education Services for Overseas Students (ESOS) Xxx 0000 and the Education Services for Overseas Students Regulations 2001, refunds, if the registered provider, defaults cannot be covered by a written agreement between the provider and the student.
