Termination of Temporary Workers. 6.1 Subject to clauses 6.2 to 6.5, Client may request Xxxxxx Xxxxxxx to terminate a Temporary Worker for any lawful reason with notice. 6.2 Client must promptly notify Xxxxxx Xxxxxxx of any performance, attendance or behavioural issues concerning a Temporary Worker during a Temporary Client Role. Xxxxxx Xxxxxxx will seek to rectify the issue prior to any request by Client to terminate the Temporary Worker. 6.3 In the event of alleged Serious Misconduct by a Temporary Worker, Client must immediately notify Xxxxxx Xxxxxxx. Xxxxxx Xxxxxxx will follow a fair and reasonable process in accordance with Workplace Laws, which may include standing the Temporary Worker down from work, conducting an investigation into the allegations, notifying the Temporary Worker of the allegations and providing the Temporary Worker with an opportunity to respond formally before making a final decision on whether there are reasonable grounds to terminate with or without notice. 6.4 Client must pay the agreed Temporary Worker notice period except for termination for Serious Misconduct, which must be handled in accordance with clause 6.3. 6.5 For the avoidance of doubt, Xxxxxx Xxxxxxx (not Client or its employees or agents) will notify a Temporary Worker of termination of a Temporary Client Role. 6.6 Client agrees to disclose any and all information affecting matters under this clause 6 immediately in writing and as requested by Xxxxxx Xxxxxxx from time to time.

Termination of Temporary Workers. (a) If the relevant Macquarie Group entity, at its discretion, considers that a Temporary Worker is unsuitable at any time during the first day of their engagement (including in the circumstances contemplated by clause (e) below), the Macquarie Group entity may terminate the Temporary Worker’s engagement by notifying the Service Provider that the Temporary Worker is unsuitable. The Service Provider will use its best endeavours to provide a replacement Temporary Worker within 24 hours and no Fees will be payable for the time worked by the unsuitable Temporary Worker. (b) If a Temporary Worker has been engaged for a fixed period and becomes unable to work for the duration of the fixed period, then the Service Provider may terminate that Temporary Worker’s engagement prior to the expiry of their engagement on the provision of two weeks’ notice to Macquarie. In this case the Macquarie Group may request that the Service Provider uses its best endeavours to provide a replacement Temporary Worker without delay for the remainder of the fixed period. (c) The engagement of each Temporary Worker is conditional on the satisfactory completion of background, immigration and reference checks required by Macquarie. Macquarie may terminate the engagement of a particular Temporary Worker at its discretion without notice if it considers that the results of a background and/or reference check are unsatisfactory, or are inconsistent with information previously provided to the Macquarie Group. (d) Unless the relevant Macquarie Group entity has decided otherwise in the manner contemplated in clause Error! Reference source not found. above, it may at its sole discretion terminate a Temporary Engagement for any reason by giving notice to the Service Provider, effective immediately. (e) For the avoidance of doubt, the stipulation of any notice period in the form referred to in clause Error! Reference source not found. above does not prevent the relevant Macquarie Group entity from terminating a Temporary Worker’s engagement without notice in circumstances including but not limited to where the Temporary Worker: (i) is or becomes charged with any criminal offence which in the reasonable opinion of Macquarie brings the Service Provider, Macquarie or the Macquarie Group into disrepute; (ii) is or becomes bankrupt; (iii) is or becomes continually or significantly absent or neglectful of their duties; (iv) has, in the opinion of Macquarie, committed misconduct; (v) is performing at a le...

  • Temporary Employment Temporary service in a position immediately preceding certification to that position, without interruption, shall count towards satisfaction of the probationary period. Each Party shall collect and maintain, and, on request, make available to the other Party in accordance with its domestic law, data respecting the granting of temporary entry under this Chapter to business persons of the other Party who have been issued immigration documentation.

  • Temporary Employee Employees may be hired for a specific term not to exceed six (6) months, to replace an employee who will be on approved leave of absence, absence due to WSIB disability, sick leave, long term disability or to perform a special non-recurring task. This term may be extended a further six (6) months on mutual agreement of the Union, employee and Hospital or by the Hospital on its own up to twelve (12) months where the leave of the person being replaced extends that far. The period of employment of such persons will not exceed the absentee's leave. The release or discharge of such persons shall not be the subject of a grievance or arbitration. This clause would not preclude such employees from using the job posting provision under the collective agreement and any successful applicant who has completed his probation period will be credited with the appropriate seniority. The Hospital will outline to employees selected to fill such temporary vacancies and the Union, the circumstances giving rise to the vacancy, and the special conditions relating to such employment.

  • Part-Time and Temporary Employees 16.1. A part-time employee is one who is hired to work regularly twenty-four (24) hours per week or less. Except as expressly provided in the circumstances described in Article 16 (3) hereunder, a temporary employee is one employed for a special project or a specified time, in either case, not to exceed three (3) months except by mutual agreement, or in the case of students, the academic vacation period, or for a specified leave of absence. The Employer shall notify the employee and the CAW of the nature and anticipated duration of all temporary employment. 16.2. Neither part-time nor temporary employees shall be employed where such employment would eliminate or displace a regular or full-time employee. The Company will continue its practice of only hiring part-time or temporary employees when it deems it impractical to hire a full-time employee. 16.3. Notwithstanding Article 16 (1) above, temporary employees may be employed to replace regular employees who are absent due to illness, injury, maternity or other leave of absence to a maximum of twelve (12) months. The period of employment of the temporary employee will cease when the regular employee on leave returns to work or when the regular employee on leave informs the Company and the CAW in writing that he/she will not be returning to work. In any event, temporary employees hired pursuant to this Article 16 (3) shall not be employed for more than twelve (12) months except by mutual agreement in writing. 16.4. A part-time employee shall be paid on an hourly basis equivalent to the weekly minimum salary provided for the employee's classification and experience. 16.5. A part-time employee shall advance on the schedule of minimum salaries and shall receive all benefits that depend on length of service according to the length of his/her employment with the Employer, according to actual hours worked, based on a 1,600-hour year. 16.6. Temporary employees shall be paid an hourly rate consistent with the minimum weekly salary provided for their classification and experience. 16.7. Part-time and temporary employees shall be covered by all provisions of this Agreement, except as provided otherwise. 16.8. In the event of a part-time or temporary employee becoming a full-time employee, he/she shall be credited with the length of his/her employment with the Employer, according to actual hours worked, based on a 1,600-hour year.

  • Temporary Layoff The Employer may temporarily layoff an employee for up to ninety (90) days due to an unanticipated loss of funding, revenue shortfall, lack of work, shortage of material or equipment, or other unexpected or unusual reasons. An employee will normally receive seven (7) days notice of a temporary layoff.

  • Termination of the Lease The parties agree that the Management Agreement and the rights and benefits of Manager thereunder shall not be terminated or disturbed in any respect except in accordance with the terms of the Management Agreement, and not as a result of any termination of the Lease. Accordingly, if the Lease is terminated for any reason, including, without limitation, expiration of the term thereof or the "rejection" thereof following Bankruptcy (a) shall recognize Manager's rights under the Management Agreement, (b) agrees that Manager shall not be named as a party in any eviction or other possessory action or proceeding, and that Manager shall not be disturbed in its right to manage the Inn pursuant to the Management Agreement, and (c) shall at the time of or prior to such Lease Termination either (i) elect not to take either of the actions described in clause (c)(ii) below, in which case all of "Lessee's" rights, benefits, privileges and obligations under the Management Agreement with respect to periods after the Lease Termination shall be assumed directly by Lessor, or (ii) cause an "Approved Lessee" (as defined below) to (x) succeed to and assume Lessee's rights and obligations under the Lease, the Management Agreement, and this Agreement, or (y) enter into a new lease with Lessor in substantially the same form as the Lease, and assume the rights and obligations of the Lessee under the Management Agreement and this Agreement, the intent being that the relationship between any successor Lessee, Lessor and Manager be under the same terms and conditions as the relationship between Lessee, Lessor and Manager hereunder and under the Management Agreement and the Lease. Any successor to Lessee under clause (c)(ii) above shall be subject to Manager's prior written approval, which approval shall not be withheld or delayed if such successor to Lessee is (i) a direct or indirect wholly-owned subsidiary of Lessor, (ii) a person or entity to whom a Sale of the Inn is permitted under Section 10.02.A. of the Management Agreement, or (iii) a person or entity who otherwise is approved by Manager in its sole discretion (an "Approved Lessee").

Upon District determination, Developer shall not be entitled to receive any further payment until the entire Work is finished. 22.3.2.3 Upon Termination, District may immediately serve written notice of tender upon Surety whereby Surety shall have the right to take over and perform this Facilities Lease only if Surety: 22.3.2.3.1 Within three (3) days after service upon it of the notice of tender, gives District written notice of Surety’s intention to take over and perform this Facilities Lease; and 22.3.2.3.2 Commences performance of this Facilities Lease within three (3) days from date of serving of its notice to District. 22.3.2.4 Surety shall not utilize Developer in completing the Project if the District notifies Surety of the District’s objection to Developer’s further participation in the completion of the Project. Surety expressly agrees that any developer which Xxxxxx proposes to fulfill Surety’s obligations is subject to District’s approval. 22.3.2.5 If Surety fails to notify District or begin performance as indicated herein, District may take over the Work and execute the Work to completion by any method it may deem advisable at the expense of Developer and/or its Surety. Developer and its Surety shall be liable to District for any excess cost or other damages the District incurs thereby. Time is of the essence in this Facilities Lease. If the District takes over the Work as herein provided, District may, without liability for so doing, take possession of and utilize in completing the Work all materials, appliances, plan, and other property belonging to Developer as may be on the Site of the Work, in bonded storage, or previously paid for.
