Grant of Temporary Entry. 1. Each Party shall grant temporary entry to business persons who comply with existing immigration measures applicable to temporary entry such as those relating to public health and safety and national security, in accordance with this Chapter and the terms and conditions of Annex 7 (Commitments for Temporary Entry for Business Persons).
2. Each Party shall limit any fees for processing applications for temporary entry of business persons so as to not unduly impair or delay trade in goods or services or the conduct of investment activities under this Agreement.
1. Further to Article 167 (Transparency) of the Chapter 13 (Transparency), and recognizing the importance to the Parties of transparency of temporary entry information, each Party shall: (a) provide to the other Party relevant materials that will enable it to become acquainted with its measures relating to this Chapter; and (b) no later than 6 months after the date of entry into force of this Agreement, make available explanatory material regarding the requirements for temporary entry under this Chapter in such a manner that will enable business persons of the other Party to become acquainted with them.
2. Each Party shall collect and maintain, and, on request, make available to the other Party in accordance with its domestic law, data respecting the granting of temporary entry under this Chapter to business persons of the other Party who have been issued immigration documentation.
Grant of Temporary Entry. Each Party shall grant temporary entry to business persons who are otherwise qualified for entry under applicable measures relating to public health and safety and national security, in accordance with this Annex.
Grant of Temporary Entry. 1. Each Party shall grant temporary entry to business persons who comply with immigration measures applicable to temporary entry such as those related to public health, safety, and national security, in accordance with this Chapter, including Annex 11A and Appendix 11A-3. 2. A Party may refuse to issue an immigration document authorizing employment to a business person where the temporary entry of that person might adversely affect: (a) the settlement of any labor dispute that is in progress at the place or intended place of employment; or (b) the employment of any person who is involved in such dispute. 3. Where a Party, in accordance with paragraph 2, refuses to issue an immigration document authorizing employment, it shall inform in writing the business person of the reasons for the refusal.
4. Each Party shall limit any fees for processing applications for temporary entry of business persons so as not to unduly impair or delay trade in goods or services or the conduct of investment activities under this Agreement and not to exceed the administrative costs normally rendered.
1. Further to Article 21.1 (Publication), and recognizing the importance to the Parties of transparency of temporary entry information, each Party shall: (a) provide the other Party with relevant materials that will enable the other Party to become acquainted with its measures related to this Chapter; and (b) no later than six months after the date of entry into force of this Agreement, prepare, publish, and make available in its own territory, and in the territory of the other Party, explanatory material regarding the requirements for temporary entry under this Chapter, including references to applicable laws and regulations, in such a manner that will enable business persons of the other Party to become acquainted with them. 2. Each Party shall collect and maintain, and, upon request, make available to the other Party in accordance with its laws, data regarding the granting of temporary entry under this Chapter to business persons of the other Party who have been issued immigration documentation, including data specific to each occupation, profession, or activity.
Grant of Temporary Entry. 1. Each Party shall, in accordance with that Party's schedule of specific commitments in Annex 4 (Schedules of Movement of Natural Persons Commitments), grant temporary entry or extension of temporary stay in accordance with this Chapter to natural persons of another Party provided those natural persons:
(a) follow prescribed application procedures for the immigration formality sought; and
(b) meet all relevant eligibility requirements for entry to the granting Party.
2. Any fees imposed in respect of the processing of an immigration formality shall be reasonable and in accordance with domestic law.
3. A Party may deny temporary entry or extension of temporary stay to natural persons of another Party that do not comply with Paragraph 1{a) and (b).
Grant of Temporary Entry. Each Party shall, in accordance with this Chapter and that Party's schedule of specific commitments in Annex 4 (Schedules of Movement of Natural Persons Commitments), grant temporary entry or extension of temporary stay to natural persons of the other Party covered by paragraph 1 of Article 10.2 (Scope), provided those natural persons:
(a) follow prescribed application procedures for the immigration formality sought; and
(b) meet all relevant eligibility requirements for the relevant immigration formality permitting temporary entry or extension of temporary stay to the granting Party.
Grant of Temporary Entry. 1. In accordance with this Chapter and subject to the provisions of Annex 13.4 and Annex 13.4.1, each Party shall grant temporary entry to business persons who are otherwise qualified for entry under applicable measures relating to public health and safety and national security.
2. A Party may refuse to issue an immigration document authorizing employment to a business person where the temporary entry of that person might affect adversely:
(a) the settlement of any labour dispute that is in progress at the place or intended place of employment; or
(b) the employment of any person who is involved in such dispute.
3. When a Party refuses pursuant to paragraph 2 to issue an immigration document authorizing employment, it shall:
(a) inform in writing the business person of the reasons for the refusal; and
(b) promptly notify the other Party in writing of the reasons for the refusal.
4. Each Party shall limit any fees for processing applications for temporary entry of business persons to the approximate cost of services rendered.
Grant of Temporary Entry. The Parties may make commitments in respect of temporary entry of natural persons.
Grant of Temporary Entry. 1. Each Party shall grant temporary entry to business persons, including spouses and dependents of intra-corporate transferees, who are otherwise qualified for entry under applicable measures including those relating to public health and safety and national security, in accordance with this Chapter, including the provisions of Annex 13-A.
2. Each Party shall ensure that fees charged by its competent authorities on applications for an immigration formality do not constitute an unjustifiable impediment to the movement of nationals under this Chapter.
3. The temporary entry granted by virtue of this Chapter does not replace the requirements needed to carry out a profession or activity according to the specific laws and regulations in force in the territory of the Party authorising the temporary entry.
Grant of Temporary Entry. 1. Each Party shall set out in Annex 10-A the specific commitments it undertakes for each of the categories of natural persons specified therein. The Parties may make commitments in respect of the temporary employment entry of natural persons.
2. Where a Party makes a commitment under paragraph 1, it shall grant temporary entry or extension of temporary stay to natural persons of the other Party to the extent provided for in that commitment, provided that those natural persons:
(a) follow the prescribed application procedures for the relevant immigration formality; and
(b) meet all relevant eligibility requirements for such temporary entry.
3. In respect of the specific commitments on temporary entry in this Chapter, unless otherwise specified in Annex 10-A, neither Party shall:
(a) impose or maintain any limitations on the total number of visas to be granted to natural persons of the other Party; or
(b) require labour market testing, economic needs testing or other procedures of similar effect as a condition for temporary entry.
4. Each Party shall limit any fees for processing applications for temporary entry of natural persons in a manner consistent with Article 10.3.
5. Temporary entry granted in accordance with this Chapter does not replace the requirements needed to carry out a profession or activity according to the applicable laws and regulations in force in the territory of the Party authorising the temporary entry.
Grant of Temporary Entry. 1. Each Party shall, in accordance with that Party’s commitments in Annex 6 (Schedules of Movement of Natural Persons Commitments), grant temporary entry or extension of temporary stay in accordance with this Chapter to natural persons of the other Party, provided those natural persons:
(a) follow prescribed application procedures for the immigration formality sought; and
(b) meet all relevant eligibility requirements for entry to the granting Party.
2. Temporary entry granted pursuant to this Chapter does not replace the requirements needed to carry out a profession or activity according to the specific laws and regulations in force in the territory of the Party authorising the temporary entry.
3. Any fees imposed in respect of the processing of an immigration formality shall be reasonable and in accordance with domestic law.
