The National Employment Standards and this Agreement. 6.1 The NES and the Agreement contain the minimum conditions of employment for Employees covered by this Agreement.
6.2 The NES applies to Employees covered by the Agreement except where the Agreement provides a greater condition or entitlement whereby the Agreement will prevail to the extent that is it more favourable than the NES.
The National Employment Standards and this Agreement. This Agreement does not exclude the NES. The NES and this Agreement contain the minimum conditions of employment for employees covered by this Agreement. If there is an inconsistency between a provision of this Agreement and the NES, and the NES is more beneficial in a particular aspect, then the NES provision will apply to the extent of the inconsistency.
The National Employment Standards and this Agreement. This Agreement operates in conjunction with the National Employment Standards. Certain provisions of this agreement may supplement the National Employment Standards, but nothing in this Agreement will provide a detrimental outcome for employees as compared to an entitlement under the NES.
The National Employment Standards and this Agreement. The NES and this Agreement contain the minimum conditions of employment for employees covered by this Agreement.
The National Employment Standards and this Agreement. 6.1 The National Employment Standards (NES) will apply in accordance with the Act. Where there is an existing NES entitlement, or the NES is varied to provide an entitlement that is more beneficial than a corresponding provision that is contained in this Agreement, the NES entitlement shall apply and the corresponding provision in this Agreement will not apply.
The National Employment Standards and this Agreement. The NES, this Agreement and the following awards contain the conditions of employment for employees covered by this Agreement:
(a) Children’s Services Award 2010
(b) Educational Services (Teachers) Award 2010
(c) Health Professionals and Support Services Award 2010
The National Employment Standards and this Agreement. 2.9.1 The National Employment Standards (NES) and this Agreement contain the minimum conditions of employment for employees covered by this Agreement.
2.9.2 This Agreement will be read and interpreted in conjunction with the NES. Where there is an inconsistency between this Agreement and the NES, and the NES provides a greater benefit, the NES provision will apply to the extent of the inconsistency.
2.9.3 The employer must ensure that copies of this Agreement and the NES are available to all employees to whom they apply, either on a notice board which is conveniently located at or near the workplace or through accessible electronic means. The employer shall provide an employee with a copy of the Agreement on request of the employee.
The National Employment Standards and this Agreement. 8.1 The NES and this Agreement contain the minimum conditions of employment for Employees covered by this Agreement, provided that where a term of this Agreement provides a greater benefit than that appearing in the NES, the relevant term of this Agreement shall apply to Employees.
8.2 The Reject Shop will ensure that copies of this Agreement and the NES are available to all Employees to whom they apply either on a noticeboard which is conveniently located at or near the workplace or through electronic means, whichever makes them more accessible.
The National Employment Standards and this Agreement. 6.1. This agreement contains and covers the minimum conditions of employment as articulated and covered in the National Employment Standards.
6.2. In the event that the SCHADS Award and/or the NES provide additional or more favourable entitlements for an employee covered by this Agreement these improvements will apply
The National Employment Standards and this Agreement. The terms of the Agreement apply in a manner that does not exclude the National Employment Standards (NES). No provision of the NES is displaced by this Agreement. The NES provisions may be supplemented by the terms of this Agreement. The NES will continue to apply to the extent that any term of this Agreement is detrimental in any respect when compared with the NES. For the avoidance of doubt, where there is an inconsistency between any term of this Agreement and the NES, and the NES provides a greater benefit, the NES provision will apply to the extent of any inconsistency.
