The Sexual Assault Response Team (SART. It is the intent of PMC to provide an inter-disciplinary approach to best serve the victims of sexual assault. In order to provide this enhanced level of service, it is necessary for a number of R.N.’s to successfully complete competency training in providing the forensic exam necessary to preserve evidence with regard to the sexual assault. Bargaining unit nurses interested in receiving competency training will be paid, at their regular hourly rate, for all time spent attending competency classes, by providers such as Xxxxxxx Xxxxxxxxxx, or other mutually agreeable agencies. Once trained, nurses will be placed on an on-call schedule. Any time a nurse is on-call as the designated Sexual Assault Forensic Examiner (“SAFE”), and not scheduled to work at PMC in the nurse’s normal capacity, the nurse will receive on-call pay of $4.50 per hour. The number of SAFE nurses and the actual scheduling of said nurses will be determined at the sole discretion of PMC. In any event, SAFE nurses shall be assigned call duties for a minimum of 96 hours per month. If a SAFE nurse is called in to participate in a sexual assault forensic exam, the nurse will be compensated at their regular hourly rate for all hours actually worked pursuant to the terms and conditions of the Collective Bargaining Agreement. A SAFE nurse who has been called in to work outside of the nurses’ regular shift schedule shall be guaranteed a minimum of two (2) hours at the applicable rate of pay, plus additional compensation consisting of one-hundred dollars ($100) per case handled. SAFE nurses receiving call assignments shall be credited for beginning work when they arrive on the worksite, notwithstanding the additional per case compensation referenced above, there shall be no duplication of pay for the same hours. When called in to participate in a sexual assault forensic exam, a SAFE nurse may be required to work for the minimum of two (2) hours. In addition, JNESO specifically agreed to, and therefore will not challenge PMC’s overall scheduling of three (3) non-union charge nurses in the emergency room. A non-union charge nurse may assume the duties of a charge RN assignment.

  • Workplace Violence Prevention and Crisis Response (applicable to any Party and any subcontractors and sub-grantees whose employees or other service providers deliver social or mental health services directly to individual recipients of such services): Party shall establish a written workplace violence prevention and crisis response policy meeting the requirements of Act 109 (2016), 33 VSA §8201(b), for the benefit of employees delivering direct social or mental health services. Party shall, in preparing its policy, consult with the guidelines promulgated by the U.S. Occupational Safety and Health Administration for Preventing Workplace Violence for Healthcare and Social Services Workers, as those guidelines may from time to time be amended. Party, through its violence protection and crisis response committee, shall evaluate the efficacy of its policy, and update the policy as appropriate, at least annually. The policy and any written evaluations thereof shall be provided to employees delivering direct social or mental health services. Party will ensure that any subcontractor and sub-grantee who hires employees (or contracts with service providers) who deliver social or mental health services directly to individual recipients of such services, complies with all requirements of this Section.

  • Drug and Alcohol Testing – Safety-Sensitive Functions A. Employees required to have a Commercial Driver’s License (CDL) are subject to pre-employment, post-accident, random and reasonable suspicion testing in accordance with the U.S. Department of Transportation rules, Coast Guard Regulations (46 CFR Part 16) or the Federal Omnibus Transportation Employee Testing Act of 1991. The testing will be conducted in accordance with current Employer policy.
