Time Off Instead of Payment for Overtime. 26.1 The Employee may request to take time off in lieu instead of receiving a payment for the overtime worked. All Employee requests will be considered in terms of the operational requirements of the business and the Employee’s individual circumstances. 26.2 Time off in lieu will be equivalent to the overtime rate that would have been payable to the Employee for the overtime worked. 26.3 If, on the termination of employment, the Employee has accrued time off for overtime worked, then the Company shall pay the Employee for the overtime at the overtime rate applicable to the overtime when worked.
