Annual Close Down. (i) The Employer may by two months’ notice in writing declare that the establishment, project or business shall observe a complete Christmas - New Year close down, such Employee shall be entitled to leave on a pro rata basis and such an Employee may be stood down for the duration of the close-down period, provided that any such Employee shall be paid for all public holidays occurring during the close-down period.
(ii) Close-down shall be deemed to mean a period of not less than four consecutive weeks, inclusive of public holidays, commencing not earlier nor later than one clear working day before Christmas Day. Provided that the close-down period may not extend for longer than three consecutive weeks, exclusive of public holidays, where the Employees agree with the Employer that annual leave may be taken in two periods.
Annual Close Down a) The Employer may by two months’ notice in writing declare that the depot, project or business shall observe a Christmas - New Year close down. Employees are entitled to leave on a pro rata basis and may be stood down for the duration of the close-down period, provided that any such employee shall be paid for all public holidays occurring during the close- down period.
b) Close-down shall be deemed to mean a period of not less than 10 consecutive working days, exclusive of public holidays, commencing not earlier nor later than one clear working day before Christmas Day. Provided that, where the employees agree with the Employer that annual leave may be taken in two periods.
c) An Employee may request a temporary transfer to an alternative depot during the annual close down. Where work is available to be undertaken, such a transfer will be permitted.
Annual Close Down. Where an employer closes down the enterprise or part of it for the purpose of allowing annual leave to all or the majority of the employees in the enterprise or part concerned, the following special provisions shall apply:
(a) The employer may, by giving not less than four weeks notice of intention so to do, stand off for the duration of the close down all employees in the enterprise or part of the enterprise concerned and allow to those who are not then qualified for a full entitlement to annual leave for 12 months continuous service, paid leave on a proportionate basis at the appropriate rate of wage as prescribed in subclauses 7.1.3 and 7.1.4 for 2.923 hours for each 38 ordinary hours worked.
(b) An employee who has then qualified for a full entitlement to annual leave for 12 months continuous service and has also completed a further week or more of continuous service, shall be allowed leave, and shall, also be paid at the appropriate rate of wage as prescribed by subclauses 7.1.3 and 7.1.4 hereof for 2.923 hours for each 38 ordinary hours worked since the close of the employee's last 12 monthly qualifying period.
(c) The next 12 monthly qualifying period for each employee affected by such close down shall commence from the day on which the enterprise or part of the enterprise concerned, is re-opened for work. Provided that all time during which an employee is stood off without pay for the purposes of this subclause is deemed to be time of service in the next 12 monthly qualifying period.
(d) (i) The employer may close down the enterprise or part of the enterprise for one or two separate periods for the purpose of granting annual leave.
Annual Close Down. The company may close down the enterprise or part of it for the purpose of allowing annual leave to all employees in the enterprise or part concerned provided it gives not less than four weeks notice of its intention to do so.
Annual Close Down. The Company may close the business down during the Christmas- New Year period. Employees with insufficient leave accumulated will be stood down without pay during the period. The Company shall give at least one (1) months' notice to the employees of the Company's intention to close down.
Annual Close Down. Despite anything contained in this agreement an employer giving any leave in conjunction with the Christmas - New Year holidays may either:
Annual Close Down. Where all or part of an operation is closed down (Christmas - January) this may be for up to 3 weeks (plus public holidays during the close down) per year. If you are affected you will be given at least one month's notice of the close down. If you have insufficient accrued annual leave you will be placed on unpaid leave, subject first to the employer making every effort to find alternative work for you. You may retain up to 5 days per year of leave to be taken at some other time during the year.
Annual Close Down. Where all or part of an operation is closed down (Christmas - January) this may be for up to 3 weeks (plus public holidays during the close down) per year. If you are affected you will be given at least one month's notice of the close down. If:
26.7.1 you have sufficient entitled leave to cover all or part of the close down, you will be required to take that leave;
26.7.2 you do not have sufficient entitled leave, you may request to take leave in advance (and these requests will not be unreasonably refused) for all or part of the close down period;
26.7.3 if your entitled leave or leave in advance does not cover the close down period, you will be placed on unpaid leave, subject first to the employer making every effort to find alternative work for you and you will be paid 8% (or the percentage equivalent of your particular leave entitlement, if higher) of your gross earnings since your last leave anniversary date or the commencement of your employment (if you have been employed for less than a year), less payment for any leave taken or cashed up. You may retain up to 5 days per year of leave to be taken at some other time during the year.
Annual Close Down. 12.3.1 Where Civilmart intends to temporarily close down the site / operation / plant or a section, or a part thereof, for the purpose of allowing annual leave to all or the majority of employees at the site / operation / plant, Civilmart will give employees concerned one month’s written notice (or notice on the day of engagement if the employee commenced employment at the site during the notice period) of this intention.
(i) An employee who has accrued enough annual leave to cover the full period of the close down must take paid annual leave for that period.
(ii) An employee who has not accrued enough annual leave to cover the full period of the close down, must take paid leave to the full amount accrued and leave without pay for the remaining period for the remaining period of the close down.
(iii) An employee who has no accrued annual leave must take leave without pay for the full period of the close down.
(iv) Any Public Holiday that falls within the period of close down will be paid in accordance with this Agreement and such day, or part thereof, will not be treated as a day of annual leave or leave without pay.
(v) Any unpaid leave taken in accordance with this clause shall not count as continuous service.
12.3.2 Civilmart may close-down the site / operation / plant for one or two separate periods in a year for the purpose of granting annual leave in accordance with this clause.
(i) If Civilmart closes down the site / operation / plant for two separate periods, one of those periods is at least fourteen consecutive days (including non-working days).
(ii) Where Civilmart and the majority of the employees in the site / operation / plant or section or sections concerned agree, Civilmart may closedown the site / operation / plant in accordance with this clause for three separate periods in a year provided one of those periods is at least fourteen consecutive days (including non-working days). Civilmart shall advise the employees concerned of the proposed dates of each close-down before asking them for their agreement.
12.3.3 Civilmart may close down the site / operation / plant or part of it for a period of at least fourteen consecutive days (including non-working days) and allow the balance of any annual leave to be taken in one continuous period in accordance with a roster.
12.3.4 Civilmart will notify new employees of an impending shutdown upon commencement.
Annual Close Down. An employee must take an amount of annual leave during a particular period if: • the employee is directed to do so by the Company because, during that period, the Company shuts down its business or any part of the business in which the employee works; and • at least that amount of leave is credited to the employee.
