Title to Construction Work. The Construction Manager warrants that title to all Work covered by an Application for Payment shall pass to the City no later than the time of payment. The Construction Manager further warrants that, upon submittal of an Application for Payment, all Work for which Applications for Payment have been previously issued and payments received from the City shall be free and clear of liens, claims, security interests or encumbrances in favor of the Construction Manager, Subcontractors, material suppliers, or other persons or entities making a claim by reason of having provided labor, materials and equipment relating to the Work.
Title to Construction Work. The Job Order Contractor warrants that title to all Work covered by an Application for Payment shall pass to the City no later than the time of payment. The Job Order Contractor further warrants that, upon submittal of an Application for Payment, all Work for which Applications for Payment have been previously issued and payments received from the City shall be free and clear of liens, claims, security interests or encumbrances in favor of the Job Order Contractor, Subcontractors, material suppliers, or other persons or entities making a claim by reason of having provided labor, materials and equipment relating to the Work.
Title to Construction Work. 6.7.1 Design-Builder warrants that title to all Construction Work covered by an Application for Payment shall pass to the Owner no later than the time of payment. Design-Builder further warrants that upon submittal of an Application for Payment, all Construction Work for which Applications for Payment have been previously issued and payments received from the Owner shall, to the best of the Design-Builder’s knowledge, information and belief, be free and clear of liens, claims, security interests or encumbrances in favor of Design-Builder, Consultants, Subcontractors, material suppliers, or other persons or entities making a claim by reason of having provided labor, materials and equipment relating to the Work. Design-Builder shall provide unconditional waivers of lien from each Subcontractor or Consultant when requested by Owner.
Title to Construction Work. Title to all the Construction Work shall pass to the City as the same or any part thereof is erected, constructed or installed and the same shall be and become a part of the Premises hereunder if located on the Premises. The foregoing provisions of this paragraph (f) shall not affect the risks and obligations assumed by the Lessee hereunder nor release the Lessee from the performance of its rebuilding and restoration obligations set forth in this Section 2.
Title to Construction Work. Title to all the Construction Work except for any Tanks shall pass to the City as the same or any part thereof is erected, constructed or installed. All of the Construction Work, except for the Terminal 5 AirTrain Connector Work, any Tank and the work as set forth in paragraph (b)(2)(viii)(cc) hereof, shall be and become a part of the Premises hereunder if located on the Premises, it being understood that all personal property for which the Lessee shall have received a Port Authority Payment for shall not be the personal property of the Lessee but instead shall be the property of the Port Authority. The foregoing provisions of this paragraph (k) shall not affect the risks and obligations assumed by the Lessee hereunder nor release the Lessee from the performance of its rebuilding and restoration obligations set forth in this Section 2.

The Design/Builder further warrants that upon submittal of an Application for Payment, all Construction Work for which Applications for Payment have been previously issued and payments received from the Owner shall be free and clear of liens, claims, security interests or encumbrances in favor of the Design/Builder, Subcontractors, material suppliers, or other persons or entities making a claim by reason of having provided labor, materials and equipment relating to the Construction Work.
Title to Construction Work. 7.8.1 The XXXX warrants that title to all construction Work covered by an application for payment shall pass to the Owner no later than the time of payment. The XXXX further warrants that upon submittal of an application for payment, all construction Work for which applications for payment have been previously issued and payments received from the Owner shall be free and clear of liens, claims, security interests or encumbrances in favor of the XXXX, Subcontractors, material men, suppliers, or other persons or entities making a claim by reason of having provided labor, materials and equipment relating to the Work or by reason of being a creditor of any of the foregoing persons or entities. XXXX shall provide unconditional waivers of lien through the date of the application for payment from each Subcontractor and supplier of any tier with each application for payment and when requested by Owner. XXXX shall also provide with each application for payment unconditional waivers of lien through the date of the prior application for payment from each Subcontractor and supplier of any tier. As a condition precedent to Final Completion of the entire Work or a phase of the Work if the Work is done in phases the XXXX shall provide unconditional waivers of lien from all Subcontractors, material suppliers, or other persons or entities having provided labor, materials and equipment relating to the entire Work or the phase of the Work, as applicable.
Title to Construction Work. The Design-Builder warrants that title to all Construction Work covered by an Application for Payment shall pass to the City no later than the time of payment. This provision shall not affect the Design-Builder’s responsibilities for protection and insurance of the work in place. The Design-Builder further warrants that upon submittal of an Application for Payment, all Construction Work for which Applications for Payment have been previously issued and payments received from the City will, to the best of the Design-Builder's knowledge, information and belief, be free and clear of liens, Claims, security interests or encumbrances in favor of the Design-Builder, Subconsultants, Subcontractors, material Suppliers, or other persons or entities making a Claim by reason of having provided labor, materials and equipment relating to the Construction Work.
Title to Construction Work. The Design-Builder warrants that title to all Construction Work covered by an Application for Payment shall pass to the Owner no later than the time of payment. The Design-Builder further warrants that upon submittal of an Application for Payment, all Construction Work for which Applications for Payment have been previously issued and payments received from the Owner shall, to the best of the Design-Builder's knowledge, information and belief, be free and clear of liens, claims, security interests or encumbrances in favor of the Design-Builder as evident by a signed Affidavit of Payment from the Design-Builder and as a condition precedent to any subsequent Payment by the Owner.
Title to Construction Work. Title to all the Construction Work shall pass to The City of New York as the same or any part thereof is erected, constructed or installed, and shall be and become part of the Premises if located within the Premises.
