Common use of Transfer outside of the Bargaining Unit Clause in Contracts

Transfer outside of the Bargaining Unit. (a) A nurse who is transferred to a position outside of the bargaining unit for a period of not more than three (3) months, or is seconded to teach for an academic year shall not suffer any loss of seniority, service or benefits. A nurse who is transferred to a position outside of the bargaining unit for a period of more than three (3) months, but not more than one (1) year shall retain, but not accumulate, her or his seniority held at the time of the transfer. In the event the nurse is returned to a position in the bargaining unit, she or he shall be credited with seniority held at the time of transfer and resume accumulation from the date of her or his return to the bargaining unit. The union will be provided notice prior to the commencement of the transfers mentioned above. A nurse must remain in the bargaining unit for a period of at least five (5) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer. (b) In the event that a nurse is transferred to a position outside of the bargaining unit for a period in excess of one (1) year, she or he will lose all seniority held at the time of transfer. In the event the nurse is returned to a position in the bargaining unit, the nurse's seniority will accrue from the date of her or his return to the bargaining unit. (c) It is understood and agreed that a nurse may decline such offer to transfer and that the period of time referred to above may be extended by agreement of the parties. (d) The Hospital agrees that it will not make work assignments that violate the purpose and intent of this provision. The Hospital will advise the local Union of the names of any nurses performing the duties of positions outside of the bargaining unit pursuant to Articles 10.11 and/or 19.04 (b), the date the assignment commenced, the area of assignment and the duration of such assignments. (e) A nurse who accepts a transfer under Article 10.11 will not be required to pay union dues for any complete calendar month during which no bargaining unit work is performed.

(b) If a term appointment is terminated prior to the original stated end date the employee with be entitled to notice of termination, pay in lieu of notice or a combination thereof, in accordance with the Employment Standards Act, 2000.

A nurse must remain in the bargaining unit for a period of at least five three (53) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer. (b) In the event that a nurse is transferred to a position outside of the bargaining unit for a period in excess of one (1) year, unless the parties agree otherwise, she or he will lose all seniority held at the time of transfer. In the event the nurse is returned to a position in the bargaining unit, the nurse's ’s seniority will accrue from the date of her or his return to the bargaining unit, unless the parties agree otherwise. (c) It is understood and agreed that a nurse may decline such offer to transfer and that the period of time referred to above may be extended by agreement of the parties. Transfer outside of the Bargaining Unit. (a) A nurse who has been requested to substitute temporarily in a classification that is excluded from the bargaining unit may refuse to do so. If she/he consents she/he shall be deemed to be covered by the Collective Agreement, but shall be compensated in accordance with the excluded classification. In the event that a nurse is transferred to a position outside out of the bargaining unit unit, as above, for a period of not more than three (3) monthsmonths and is returned to a position in the bargaining unit, or is seconded to teach for an academic year shall she/he will not suffer any loss of seniority, service or benefits. A nurse who is transferred temporarily to a position outside of the bargaining unit for a period of more than three (3) months, months but not more than one (1) year year, with the option to extend if mutually agreed upon by both parties, shall retain, retain but not accumulate, her or his seniority held at the time of the transfer. In the event the nurse employee is returned to a position in the bargaining unit, she or she/he shall be credited with seniority held at the time of the transfer and resume accumulation from the date of her or his return to the bargaining unit. (ai) A nurse Nurse who is transferred to a position outside of the bargaining unit for a period of not more than three (3) months, or is seconded to teach for an academic year months shall not suffer any loss of seniority, service service, or benefits.
