Transfer Return Rights. An employee who is transferred by the Company from one of the units described in Article 1 to another, and at the time of such transfer is accorded return rights by the Company in writing, will not be laid off while assigned at such other unit, but will be transferred back to the original unit in accordance with the return rights previously accorded by the Company. An exception will be made if the employee elects to be laid off in which case the employee will waive transfer return rights.
Transfer Return Rights. The parties agree that, the following procedure shall be followed once an employee-requested transfer has taken place:
1. Employees who have requested and accepted transfer positions, either within the CEA bargaining unit or to other City positions, shall have the right, during the first six months of their qualifying period, to voluntarily return to their former department in the same classification.

An exception will be made 16 if the employee elects to be laid off in which case the employee will waive transfer return rights. 17

An exception will be made if the engineer 31 elects to be laid off in which case the engineer will waive transfer return rights.

The Company will not 26 not normally approve part-time work schedules for employees with less than two (2) 27 years of Company service; provided, however, that the Company may rehire retirees 28 on part-time schedules.
