Return Rights. The President and Vice-President will have the right to return to the same position or in another position in the same job classification and the same geographic area as determined by the Employer, provided such reemployment is not in conflict with other articles in this Agreement. The employee and the Employer may enter into a written agreement regarding return rights at the commencement of the leave. The period of leave will not impact the employee’s seniority date.

Return Rights. The President and Vice-President will have the right to return to the same or a comparable position, provided such position is vacant or occupied by a temporary employee, and provided such reemployment is not in conflict with other articles in this Agreement. The employee and the College may enter into a written agreement regarding return rights prior to the commencement of the leave.
Return Rights. Upon assignment to a new or vacant position, a NAV CANADA employee shall be granted a familiarization period of up to forty-five (45) days worked during which the employee or NAV CANADA may determine that the employee be returned to his or her former position subject to the following: (a) the parties may mutually agree to extend the familiarization period for up to a further forty-five (45) days; (b) the employee shall be compensated in accordance with the Travel and Relocation Programs for expenses incurred during the familiarization period; (c) no relocation expenses shall be paid to the employee during the familiarization period unless otherwise mutually agreed, however once relocation expenses have been paid the employee will forego the right to return to his or her former position; (d) the familiarization period and return rights may be dispensed with by mutual agreement between parties.
Return Rights. Any employee or SUCCESS employee assigned to an administrative or supervisory position that subsequently becomes a member of the bargaining unit shall be entitled to retain such rights as may have accrued under this Agreement.

Return Rights. The employee shall return to previously assigned full-time duties upon submission of a statement from the attending physician certifying physical and mental fitness to resume such duties. Upon returning to employment, the employee shall assume all previous rights and privileges.
Return Rights. (a) A successful applicant under either the National or Interim Bid Program (excluding Transfer Down) or the competitive process for Operational Supervisor positions shall retain his or her position during training. Such “return rights” shall be extinguished at the date on which the successful applicant qualifies in the new position. (b) A successful candidate for Data Systems Co-ordinator and non- operating positions shall have a sixty (60) day period of “return rights” following his or her report to the new position, subject to the following: (i) the return rights period may be extended by mutual agreement; (ii) no relocation expenses shall be paid during the return rights period unless mutually agreed otherwise. In the latter case the return rights shall be extinguished; (iii) the employee shall receive travel expenses in accordance with the NAV CANADA Joint Council Travel Guidelines during the return rights period.
