Common use of Transfers to Positions Outside of the Bargaining Unit Clause in Contracts

Transfers to Positions Outside of the Bargaining Unit. (a) A nurse who is transferred to a position outside of the bargaining unit shall continue to accrue seniority for a period of up to twelve (12) months, and shall not suffer any loss of service or benefits. A nurse who is transferred to a position outside of the bargaining unit for a period of more than 12 months, but not more than 24 months, shall retain, but not accumulate seniority. A nurse must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or the nurse will lose all seniority held at the time of the subsequent transfer.
